Member Thedore Willard introduced the following resolution
and moved its adoption:
RESOLUTION NO. 69 -114
RESOLUTION RESCINDING RESOLUTION NO. 68 -270 ADOPTED
NOVEMBER 25, 1968 AND RESOLUTION NO. 69 -10 ADOPTED
JANUARY 6, 1969, AND AMENDING RESOLUTION NO. 68 -269
ADOPTED NOVEMBER 25, 1968
WHEREAS, Resolution No. 68 -269 established Storm Sewer
Improvement Project No. 1969 -39, and
WHEREAS, Resolution No. 68 -270 established Storm Sewer
Improvement Project No. 1969 -42, and
WHEREAS, Resolution No. 69 -10 established Storm Sewer
Improvement Project No. 1969 -59, and
WHEREAS, subsequent to the establishing of Storm Sewer
Improvement Projects No. 1969 -39, 1969 -42, and 1969 -59 additional
storm sewer service was requested by the developer, thereby making
it more feasible to incorporate the storm sewer construction work
described in Projects No. 1969 -42 and 1969 -59 into Storm Sewer
Improvement Project No. 1969 -39.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Brooklyn Center to rescind Resolutions No. -68 -270 and
No. 69 -10 and to amend so much of Resolution No. 68 -269 as pertains
to the description of said improvement project to read as follows:
1969 -39 Storm Sewer
Shingle Creek Parkway from County Road 10 to I.H. 94;
Sheehan Road from Shingle Creek Parkway to T.H. 100;
Lushine Drive from Shingle Creek Parkway to T.H. 100;
65th Avenue North from Humboldt Avenue to approximately
1,000 feet west of Humboldt Avenue; on easement overlying
the extension of 65th Avenue North from approximately
1,000 feet west of Humboldt Avenue to approximately 1,715
feet west of Humboldt Avenue; on easement southwesterly
overlying the northeasterly extension of Shingle Creek
Parkway to I.H. 94; on easement adjacent to the northerly
side of I.H. 94 to approximately 300 feet southeasterly
of Shingle Creek Parkway to inplace storm sewer stub; on
easement adjacent to the southerly side of I.H. 94 from
inplace storm sewer stub to approximately 270 feet north-
westerly; and on easement on the east side of Shingle Creek
Parkway from I.H. 94 to approximately 760 feet southwesterly
of the southerly right -of -way line of I. 94.

RESOLUTION NO. 69 -114
The motion for the adoption of the foregoing resolution was duly
seconded by member John Leary and upon vote being taken
thereon, the following voted in favor thereof Philip Cohen, John Leary,
Earl Rydberg, Howard Heck and Theodore Willard;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
