Member Howard Heck introduced the following resolution
and moved its adoption:
RESOLUTION NO. 69 -126
RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED STORM
SEWER IMPROVEMENT PROJECT NO. 1969 -39
WHEREAS, it is proposed that there be constructed improvements
consisting of the following:

(M.S.A.P. Co. Rd. 10 to I.H. 94; Sheehan Rd. from Shingle
09- 109 -01 Creek Pkwv to T.H. 100; Lushine Drive from
Shingle Creek Pkwy to T.H. 100; 65th Ave. No.
09- 111 -03) from Humboldt Avenue to approx. 1,000 feet west
of Humboldt Avenue; on easement overlying the
extension of 65th Ave. No. from approx. 1 ft.
west of Humboldt Avenue to approx. 1 feet
west of Humboldt Avenue; on easement southwesterly
overlying the northeasterly extension of Shingle
Creek Pkwy to I.H. 94; on easement adjacent to the
northerly side of I.H. 94 to approx. 300 feet
southeasterly of Shingle Creek Pkwy to inplace
storm sewer stub; on easement adjacent to the
southerly side of I.H. 94 from inplace storm sewer
stub to approx. 270 feet northwesterly; and on
easement on the east side of-Shingle Creek Pkwy
from I.H. 94 to approx. 760 feet southwesterly
of the southerly right -of -way line of T.H. 94. $412
WHEREAS, the City Engineer has made a preliminary report ad-
vising that said proposed improvements are feasible and that they
can be constructed at estimated costs as indicated above.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Brooklyn Center, Minnesota, as follows:
1. The Council proposes to proceed under authority granted by
Chapter 429, Minnesota Statutes,
2. A public hearing on the proposed improvements shall be
held at the City Hall in the City on Monday, the 21st day of
April, 1969, at 8:00 o'clock P.M., central standard time,
and the Clerk shall publish notice of the time and place of hearing
by two weeks' publication in the official newspaper of the City.

3. The area proposed to be assessed for said improve-
ment consists of all property located within the following area:
All that part of TWIN CITIES INTERCHANGE PARK and
BROOKLYN CENTER INDUSTRIAL PARK PLAT 1 in Hennepin
County, Minnesota, bounded on the east by T.H. 100
bounded on the north by I.H. 94, and bounded on the
west by a line 400 feet westerly of and parallel
with the west right -of -way line of Shingle Creek
Parkway;
and all that part of Section 35, T. 119, R. 21,
Hennepin County, Minnesota, lying south of the north
half of the northeast quarter, bounded on the west
by the northeasterly extension of a line 400 feet
northwesterly and parallel with Shingle Creek Parkway,
bounded on the south by I.H. 94, and bounded on the
east by Humboldt Avenue North.
4. This proposed improvement shall be designated
Storm Sewer Improvement Project No. 1969 -39.

The motion for the adoption of the foregoing resolution was duly
seconded by member Earl Rydberg and upon vote being taken
thereon, the following voted in favor thereof: Philip Cohen, john Leary
Earl Rydberg, Howard Heck and Theodore Willard;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
