HomeMy WebLinkAbout1969-155 CCR 187 Member john Leary introduced the following resolution and moved its adoption: RESOLUTION NO. 69 -155 RESOLUTION DECLARING CERTAIN BUILDINGS LOCATED AT 807 73RD AVENUE NORTH, BROOKLYN CENTER, MINNESOTA, DILAPIDATED BUILDINGS AND ORDERING THEM TO BE REMOVED WHEREAS, Laverne E. Linder is the record owner of the property located at 807 -,73rd Avenue North, Brooklyn Center, Minnesota, described as that part of Lot 36, Auditor's Subdivision No. 310, lying North of the Easterly extension of North line of Woodbine Lane (Plat 89104, Parcel 4130); and WHEREAS, the buildings on this property are best described as a 40' x 30' wood frame barn with a loft above and a 50' x 24' wood frame chicken house; and WHEREAS, after numerous complaints, J. R. Murphey, Building Inspector, did inspect said property and notified the owner; that the premises are generally abandoned and in a dilapidated and extreme state of disrepair; stating that the buildings are open to tresspassers and children playing in the area are liable to become injured and have their health endangered by the trash that is lying about; and WHEREAS, pursuant to Section 203 of the Uniform Building Code, which Code has been adopted by the City of Brooklyn Center, the Building Inspector has found the buildings to be unsafe as defined in this section; and WHEREAS, the City Council of the City of Brooklyn Center finds that the above described buildings are inadequately maintained, are dilapidated and in a state of extreme disrepair; are in an unsanitary condition; constitute a hazard to public safety; a menace to public health and a fire hazard; violates Section 203 of the Building Code and Section 35 -111 of the Zoning Ordinance, NOW, THEREFORE, BE IT RESOLVED, that Laverne E. Linder shall be ordered to remove, according to law, the wooden structures located at 807 73rd Avenue North, Brooklyn Center, Minnesota, on the property legally described as: That part of Lot 36, Auditor's Subdivision No. 310, lying North of Easterly extension of North line of Woodbine Lane (Plat 89104, Parcel 4130), as filed in the Register of Deeds Office in and for the County of Hennepin, State of Minnesota 1,89 Resolution No. 69 -155 and that this action is being taken pursuant to Minnesota Statutes Sections 463.15 463.26 on the grounds that said buildings are hazardous buildings within the meaning of that statute; BE IT FURTHER RESOLVED that Laverne E. Linder, his heirs or assigns, must comply with this order within twenty (20) days from the date of service upon him or within twenty (20) days file an answer thereto, otherwise a motion for summary enforcement of this order will be taken by the City of Brooklyn Center in the Hennepin County District Court. April 7, 1969 Date Mayor ATTEST: Clerk The motion for the adoption of the foregoing resolution was duly seconded by member Earl Rydberg and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, John Leary, Earl Rydberg, Howard Heck and Theodore Willard; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted.
