HomeMy WebLinkAbout1969-186 CCR )7 Member john Leary introduced the following resolution and moved its adoption; RESOLUTION NO. 69 -186 RESOLUTION DENYING APPLICATION 69013 SUBMITTED BY TERRY E. HARRINGTON WHEREAS, on March 5, 1969 Jerry E. Harrington filed Planning Commission Application No. 69013 requesting rezoning from R -1 to R -5 classification that property located between the north line of Northgate Addition and the south line of F.A.I. 94 and generally lying between Noble Avenue and Kyle Avenue extended northward; and WHEREAS, the application was considered by the Planning Commission on April 3, 1969 at which time a public hearing was conducted regarding the proposed rezoning; and WHEREAS, after gathering information from the applicant and from adjacent owners of- property the Planning Commission formally moved to recommend to the Council the denial of Application No. 69013; and WHEREAS, Application No. 69013 was considered by the City Council on April 14, 1969 at which time information was submitted by the applicant, Jerry Harrington, and by owners of adjacent property; and WHEREAS, it was determined that the subject property consisted of a remnant of a larger parcel which was acquired by the Minnesota Highway Department for highway purposes, with the remnant eventually being conveyed back to the owner from whom acquired; and q WHEREAS, information was presented that the 130 ft. deep by 1146 ft. long parcel was partially filled with excess earth materials from the highway construction; and WHEREAS, the applicant contended that it was uneconomical to develop the property for R -1 purposes and on the basis of inaccurate utility cost.. estimates contended that such utility costs would amount to approximately $10,000 per developed single family lot; and WHEREAS, the City Manager estimated on the basis of ten developable single family lots the costs would more accurately not exceed $2500 to $3000 per lot; and WHEREAS, members of the Council have considered the application in light of the text and intent of the Comprehensive Plan adopted in November of 1966; and WHEREAS, after receiving testimony and information from all concerned it was the unanimously stated consensus of the Councilmen that an approval of the application would create a degrading effect within the wholly single family neigh: borhood; and 20 9 RESOLUTION NO. 69-186 WHEREAS, the City Manager was directed to draft a resolution denying Planning Commission Application No. 69013 on the basis of reasons enunciated by the City Council, including: 1. The subject property has continuously been conceived as R -1 in nature and there has been no significant change relating to the property since the last zoning review in June, 1968; 2. The proposed rezoning violates the general concepts of the Comprehensive Plan; 3. The proposed rezoning constitutes spot zoning; 4. The proposed rezoning does not meet the goals of the Comprehensive Plan for the west central neighborhood 5. The cost of developing the subject land for R -1 purposes is not substantiallydifferent from the cost of developing the land for R -5 purposes; 6. With respect to non economic factors, no reliable testimony was introduced to indicate that it is not feasible to develop the -land for R -1 use. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota- to deny Planning Commission No. 69013 as submitted by Jerry E. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, John Leary, Earl Rydberg, Howard Heck and Theodore Willard; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted.
