The Mayor announced that the meeting was open for the con-
sideration of proposed Storm Sewer Improvement Project No. 1969 -39.
The Clerk produced an affidavit of publication of notice of
hearing on the proposed improvement showing two weeks' publication
thereof in the official newspaper, the last publication being on
May 8, 1969, which affidavit was examined and found satis-
factory and ordered placed on file.
The Mayor then called upon all property owners present to
present arguments either for or against the proposed improvement.
After hearing and considering all objections, and the property
owners appearing in favor of said improvement, member Theodore Willard
introduced the following resolution and moved its adoption:
RESOLUTION NO. 69 -208
RESOLUTION ORDERING CONSTRUCTION OF STORM SEWER
IMPROVEMENT PROJECT NO. 1969 -39
BE IT RESOLVED by the City Council of the City of Brooklyn
Center, Minnesota, that it is hereby determined that it is necessary
and for the best interests of the City and the owners of property
specially benefitted thereby, that the following improvement shall be
constructed:
Project No. 1969 -39 Storm sewer in Shingle Creek Pkwy from
Co. Rd. 10 to I.H. 94; Sheehan Road from Shingle Creek Pkwy to T.H.100;
Lushine Drive from Shingle Creek Pkwy to T.H. 100; 65th Ave. No. from
Humboldt Avenue to approx. 1,000 ft. west of Humboldt Avenue; on ease-
ment overlying the extension of 65th Ave. No. from approx. 1 ft,
west of Humboldt Ave. to approx. 1,715 ft. west of Humboldt Avenue; on
easement southwesterly overlying the northeasterly extension of Shingle
Creek Pkwy to I.H. 94; on easement adjacent to the northerly side of
I.H. 94 to approx. 300 ft. southeasterly of Shingle Creek Pkwy to in-
place storm sewer stub; on easement adjacent to the southerly side of
I.H. 94 from inplace storm sewer stub to approx. 270 ft. northwesterly;
and on easement on the east side of Shingle Creek Pkwy from S.H. 94 to
approx. 760 ft. southwesterly of the southerly right -of -way line of IH 94.
The estimated cost is $472,570 00 tase o co ract bid prices.

The motion for the adoption of the foregoing resolution was duly
seconded by member Howard Heck, and upon vote being taken
thereon, the following voted in favor thereof: Philip Cohen,
John Leary, Earl Rydberg I Howard Heck, 'and Theodore Willard;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
