Member John Leary introduced the following resolution and moved its adoption: RESOLUTION NO. 69 -109 RESOLUTION APPROVING PLANNING COMMISSION APPLICATION NO. 68018 AS REVISED WHEREAS, on April 15, 1968 Glad and Miller Construction Company filed Planning Commission Application No. 68018 requesting rezoning from 0-2 to R -5 that property generally located south of Lakeside Avenue, north and west of T. H. 100, and east of Lower Twin Lake; and WHEREAS, on May 2, 1968 and June 6, 1968 the application was considered by the Planning Commission and recommended for denial on the general basis of inadequate and unsafe traffic access; and WHEREAS, Application No. 68018 was considered by the City Council on June 17, 1968 and subsequently tabled to August 5, 1968 and again to August 19, 1968; and WHEREAS, on August 19, 1968 the matter was tabled with the concurrence of the applicant for the purpose of obtaining additional information from outside consultants; and WHEREAS, on November 18, 1968 the City Council enacted Resolution No. 68 -251 deferring action on Application No. 68018 for an additional ninety days to permit the gathering of additional data; and WHEREAS, the City Manager commissioned evaluation appraisals related to the subject property and he also commissioned Mr. Howard Dahlgren of Midwest Planning and Research, Inc. to perform a land use analysis of the subject property; and WHEREAS, in a report dated January 14, 1969 Howard Dahlgren submitted such a report which generally recommended a land use consisting of multiple dwellings toward the easterly portion of the subject property, with a parkway connecting into Twin Lake Avenue and with the Twin Lake beach property lying westerly thereof to be dedicated by the developer for park and parkway purposes in consideration of appropriate density credits; and WHEREAS, valuation appraisals indicated a value of $135, 000.00 for the 8.5 acres if used for R -5 purposes and $66, 000.00 if used for R -1 purposes; and WHEREAS, on January 20, 1969 a petition calling for the purchase of the Twin Lake beach property was presented to the City Council; :arid Resolution No. 69 -109 16 WHEREAS, also on January 20, 1969 Application No. 68018 was again considered by the City Council and remanded back to the Planning Commission for review and recommendation based upon the concepts proposed in the Midwest Planning report and upon staff information, including (1) a preliminary layout illustrating how a neighborhood park might be developed consistent with the provisions of the Midwest proposal, (2) an indication from the Minnesota Highway Department regarding City use of a portion of excess T. H. 100 right -of -way for park purposes, and (3) a traffic analysis of the existing and the proposed traffic volumes; and WHEREAS, the matter was heard by and information was presented to the Planning Commission on February 6, 1968 and February 10, 1968 with the resulting recommendation that the application be denied "because it amounts to a repudiation of the Comprehensive Plan for a single family community in this area, and therefore a study should be made to consider the desirability of changing the entire neigh- borhood to R -5 zoning and WHEREAS, three of seven Planning Commissioners went on record as being in favor of amended Application No. 68018 along the concept outlined in the Midwest Planning and Research, Inc. report; and WHEREAS, on February 24, 1969 Application No. 68018 was again considered by the City Council along with a presentation of the information developed by the City staff; and WHEREAS, after hearing from the audience, members of the Council individually stated their observations and opinions, with a general consensus that the facts which were gathered over a nine month period would not legally support a denial of the application as informally amended along the lines of the Dahlgren report; and WHEREAS, the applicant offered a means of implementing the park and parkway provisions of the Dahlgren report; and WHEREAS, the City Manager was directed to prepare a draft resolution which would approve rezoning from 0-2 to R -5 the easterly approximate 5.35 acres of the applicant's property with the understanding that the applicant will formally amend his application accordingly; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center to approve Application No. 68018 (as revised) and to thereby proceed with rezoning from 0-2 to R -5 the easterly approximate 5.35 acres of that property generally located south of Lakeside Avenue, no th and west of T. H. 100, and east of Lower Twin Lake.
