and moved its adoption:
RESOLUTION NO. 68 -233
RESOLUTION ORDERING A CERTAIN BUILDING LOCATED
AT 5344 CAMDEN AVENUE NORTH, BROOKLYN CENTER,
MINNESOTA, TO BE RAZED AND REMOVED
WHEREAS, Edward A. Munson is the record owner of the property
located at 5344 Camden Avenue North, Brooklyn Center, Minnesota,
described as the South 1/2 of Lot 15, Block 2, Bellvue Acres
Addition; and
WHEREAS, the buildings on this property are best described
as an 18 foot by 22 foot, wood frame dwelling with a 5 foot by
11 foot shed roofed bathroom addition attached to the North side
thereof and a 17 foot by 20 foot detached garage structure which
is located in the rear yard; and
WHEREAS, after numerous complaints, J. R. Murphey, Building
Inspector of the City of Brooklyn Center and R. M. Hutchison,
City Sanitarian on the 27th day of September, 1968, inspected
the property and notified the owner that the premises are generally
abandoned and in a dilapedated and extreme state of disrepair;
stating that the house is open to tresspassers and children
playing in the neighborhood and are liable to physical injury
and have their health endangered by the filth and trash that is
lying about; and
WHEREAS, pursuant to Section 203 of the Uniform Building
Code, which Code has been adopted by the City of Brooklyn Center,
the Building Inspector has found the dwelling structure to be an
unsafe building as defined in this section and has posted a
notice at each entrance to the building stating that the building
is unsuitable for human occupancy, and

WHEREAS, pursuant to Section 140.150 of the Electrical
Ordinance, the Electrical Inspector has found the wiring so defective
as to be likely, in his opinion, to cause potential fires or
accidents, or endanger persons or property and to prevent such
accidents or danger, said Inspector has caused the electrical
service to be disconnected; and

WHEREAS, the City Council of the City of Brooklyn Center finds
that the above described buildings are inadequately maintained,
dilapedated and in a state of extreme disrepair; are in an
unsanitary condition; constitute a hazard to public safety, a
menace to public health and a fire hazard, violates the Building
Code;
NOW, THEREFORE, BE IT RESOLVED that Edward A. Munson shall be
ordered to raze and remove the dilapedated structures located at
5344 Camden Avenue North, Brooklyn Center, on the property legally
described as:
The South 1/2 of Lot 15, Block 2,
Bellvue Acres Addition.
And that this action is being taken pursuant to Minnesota Statutes
Annotated ss. 463.15 463.26 on the grounds that said building
is a hazardous building within the meaning of that statute;
BE IT FURTHER RESOLVED that Edward A. Munson, his heirs and
assigns, must comply with this order within twenty (20) days from
the date of service upon him or within twenty (20) days file an
answer thereto, otherwise a motion for summary enforcement of
this order will be taken by the City of Brooklyn Center in Hennepin
County District Court.

The motion for the adoption of the foregoing resolution was duly
seconded by member Howard Heck and upon vote being taken
thereon, the following voted in favor thereof: Philip Cohen, john
Leary, Earl Rydberg, Howard Heck and Theodore Willard;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
