HomeMy WebLinkAbout1968-119 CCRMember Howard Heck and moved its adoption: RESOLUTION NO. 68 -119 introduced the following resolution RESOLUTION DENYING APPLICATION NO. 68019 WHEREAS, Darrel Farr has submitted Application No. 68019 requesting rezoning of the following property: Northeast quadrant of intersection of 65th Avenue and Willow Lane (Lot 1, Block 2, Farrs First Addition); and WHEREAS, the Planning Commission heard and considered Application No. 68019 on May 2, 1968, recommending that the application be denied by reason of conflict with the Comprehensive Plan, and WHEREAS, similar rezoning requests were considered by the Planning Commission on January 7, 1963, and May 13, 1965, and by the City Council on June 10, 1963, and on May 24, 1965; and WHEREAS, the Planning Commission and City Council on those dates denied the application for the following reasons: 1. The Comprehensive Plan of the City does not call for multiple dwelling use for Lot 1, Block 2. 2. The applicant has not brought forward any facts suggesting that Lot 1, Block 2 has unusual conditions which would make residential development unreasonable, except that mention has been made that the lot is lower than some of the neighboring property, though this has been caused by the removal of dirt from the property; 3. The applicant has not brought forward any facts that demonstrate that Lot 1, Block 2 would have no marketable value for single family dwelling purposes; 4. R 5 type of apartments on Lot 1, Block 2 would be..of a much larger scale and size than the neighboring residential dwellings; 5. The residents of the neighboring single family dwellings have stated at the public meetings that they purchase or constructed their dwellings relying upon the residential zoning of the lots abutting the Mississippi River; and 1 WHEREAS, the City Council heard and considered Application No. 68019 on May 13, 1968, including the recommendation of the Planning Commission and the comments of interested parties; and WHEREAS, as a result of said considerations the City Council concludes as follows: ATTEST: 1. The rezoning of Lot 1, Block 2, of Farr's 1st Addition, would be contrary to the Comprehensive Plan and a multiple dwelling upon said lot and abutting the river, would break the continuity of residential development of the lots to the North and South, in that it would place a more intensive land use and a large out -of -scale building in a line of heretofore residential single family development; 2. The neighboring residents have invested years of time and a substantial measure of their resources developing the residential lots abutting the river and it would be unfair to permit the requested R 5 use; 3. The essential character of the lots abutting the river is residential single family; 4. The fact that the applicant owns both Lots 1 and 2 of Block 1 of Farr's 1st Addition would allow both lots access to the river landing of Lot 1, Block 2 and would multiply the activity on the lot marry times, and thus aggravate the conflict between this lot and the neighboring single family lots; 5. The general conditions of the area have not substantially changed from January 7, 1963 to this date. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota, that the application of Darrel Farr, No. 68019, for rezoning of Lot 1, Block 2 of Farr's First Addition, is ied. The motion for the adoption of the foregoing resolution was duly seconded by member John Leary and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, John Leary, Earl Rydberg and Howard Heck; and the folio wing voted against the same: none, whereupon said resolution was declared duly passed and adopted.
