HomeMy WebLinkAbout1968-139 CCRMember Theodore Willard introduced the following resolution and moved its adoption: RESOLUTION NO. 68 -139 RESOLUTION REGARDING APPLICATION NO, 68004 WHEREAS, on April 15, 1968 the City Council considered Application No. 68004 relating to a request by the Shell Oil Company for Special Use Permit and Plan Approval for its service station at 63rd and Osseo Road; and WHEREAS, considering the request the City Council reviewed the factors of the Planning Commission's favorable recommendation and heard from repre- sentatives of Shell Oil Company and members of the city staff; and WHEREAS, the matter was tabled for further consideration by the City Council until April 29, 1968 and, with the concurrence of the of the applicant, subsequently re- tabled until May 13, 1968; and WHEREAS, on May 13, 1968 the City Council concluded that the proposed service station renovation constituted a Major alteration tantamount to the erection of a new structure, and further concluded that the use should meet established standards;, and WHEREAS, on May 13, 1968 the applicant concurred in a re- tabling until June 3, 1968, agreeing to review the City Council's recommendation that the site and building plans be revised to incorporate the standard condition of a 15 foot no activity greenstrip along the streets; and WHEREAS, on June 13, 1968, the applicant reported that the plans had not been revised to provide the standard 15 foot no activity greenstrip, indicating that the condition would require moving the building location thereby likely deferring the project some period of months until company funds were appro- priated; and WHEREAS, members of the City Council agree with and encourage the applicant's intentions to renovate and expand the subject service station use, subject to standard requirements and conditions; and NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota, that Application No. 68004 be denied. WHEREAS, upon the applicant's failure to meet standard requirements and conditions relating to such land uses, the City Council directed that a draft resolution be prepared for City Council review which would deny Application No. 68004 in the form presented: BE IT FURTHER RESOLVED that the applicant is encouraged to renovate and expand the subject service station use subject to meeting standard requirements and conditions. Resolution No. 68 -139 ATTEST: June 17, 1968 Date The motion for the adoption of the foregoing resolution was duly seconded by and upon vote being taken thereon, the following Philip Cohen, John Leary, Howard Heck and member Howard Heck voted in favor thereof: Theodore Willard; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted. 127
