HomeMy WebLinkAbout1968-031 CCRMember Theodore Willard introduced the following resolution and moved its adoption: RESOLUTION NO. 68 -31 RESOLUTION APPROVING APPLICATION NO. 67072 SUBMITTED BY MILES LUMBER COMPANY WHEREAS, Miles Lumber Company has submitted Application No. 67072 requesting approval of site and building plans of a proposed apartment development on approximately 3 acres of land between 69th 70th Avenues North to the west of Humboldt Avenue, to be known as Lot 3 of Block 1, Horbal Addition; and WHEREAS, said site and building plans were reviewed by the Planning Commission on January 4, 1968, with recommendations relating thereto being submitted to the City Council on January 25, 1968, at which time the Council has also reviewed said plans, and is fully informed thereto: NOW, THEREFORE, the City Council approves the site and building plans for the submitted 50 unit complex, the land area being deficient by the equivalent of approximately one -half a unit; the following stipulations and conditions shall be met: 1. Prior to the issuance of building permits, the site shall be set out as a single lot in a duly recorded plat; 2. The interior and exterior periphery of the parking areas shall be delineated with a continuous poured -in -place concrete curbing, 6" wide by 18" deep with 6" of exposed surface. Furthermore, the north and south fences shall be located approximately 6" from the respective property lines, and the easterly fence shall be located approximately 10 feet from the easterly property line; 3. All areas on the site not paved or covered with building structure shall be sodded, including the street boulevard areas along Humboldt and future Irving Avenues; 4. A drainage plan for the property shall be submitted to and approved by the City Engineer; 5. The building plans shall be subject to the approval of the Building Inspector with respect to applicable building codes; 6. The developer and his heirs, assigns, and successors recognize and agree that standard assessments for public improvements in Irving Avenue will be assessed to the property in the event Irving Avenue is developed; 1 Resolution No. ATTEST: 68 -31 7. A performance agreement and bond guaranteeing the installation and maintenance (for a period of five years) of all site improvements shall be executed by the developer and submitted to the City, the amount of such bond to be determined by the City Manager. February 5, 1968 Date The motion for the adoption of the foregoing resolution was duly seconded by member John Leary and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, John Leary, Earl Rydberg, Howard Heck and Theodore Willard; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted.
