moved its adoption:
WHEREAS, on November 13, 1967, the City Council approved the site
and building plans relative to Planning Commission Application No. 67058,
the Kentucky Fried Chicken establishment in the Brookdale complex; and
WHEREAS, legal counsel for the applicant has since suggested that
the site and building plans conflict with Section 35 -603 of the City Ordinances
and has further suggested that a variance be granted from the provisions of
Section 35 -603 of the City Ordinances:
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of
Brooklyn Center, Minnesota, that the site and building plans relative to
Planning Commission Application No. 67058 do not in the determination of
the City Council conflict with Section 35 -603 of the City Ordinances and the
Building Inspector is hereby directed to issue a building permit for said
establishment, provided all other requirements and ordinances are met.

The motion for the adoption of the foregoing resolution was duly seconded by
member Earl Rydberg and upon vote being taken thereon, the
following voted in favor thereof: Philip Cohen, John Leary, Earl Rydberg,
Howard Heck, and Theodore Willard
and the following voted against the same: none
whereupon said resolution was declared duly passed and adopted.
