HomeMy WebLinkAbout1968-073 CCR1 1 Member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION NO. 68 -73 RESOLUTION REGARDING PLANNING APPLICATION NO. 67005 CHAZIN, GILLES AND SHELL OIL COMPANY vs. THE CITY OF BROOKLYN CENTER WHEREAS, on February 8, 1967, Application No. 67005 was filed with the City of Brooklyn Center; and WHEREAS, said Application No. 67005 requested rezoning and service station special use permit for that property generally located west of France Avenue North and south of Trunk Highway 100; and WHEREAS, after numerous meetings for the consideration of said application, the City Council on June 12, 1967 denied the request for rezoning and service station special use permit; and WHEREAS, Norman Chazin, Myra L. Chazin, Isolda Gilles and Shell Oil Company caused a summons and complaint to be served on the City of Brooklyn Center on October 7, 1967; and WHEREAS, the plaintiff and the City of Brooklyn Center have conducted discovery proceedings and have been apprised of facts relative to the issues involved in the matter; and WHEREAS, the City Attorney and City Manager have evaluated the facts and the results of the discovery proceedings and have on March 11, 1968 recommended that the City Council authorize the City Attorney to enter into negotiations leading to a Stipulation of dismissal in the matter; and WHEREAS, the City Attorney has submitted a Stipulation document containing the provisions upon which the legal action might be dismissed, said document being contained in the official files of the Planning Commission No. 67005: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center to authorize the City Attorney to execute the Stipulation agreement as presented. March 25, 1968 ATTEST: Clerk 1 Resolution No. 68 -73 The motion for the adoption of the foregoing resolution was duly seconded by member John Leary, and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, John Leary, Earl Rydberg, Howard Heck and Theodore Willard, and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted.
