HomeMy WebLinkAbout1967-344 CCR1 1 1 Member Gordon Erickson introduced the following resolution and moved its adoption: RESOLUTION NO. 67 -344 RESOLUTION ACCEPTING WORK (CONTRACTED BY VILLAGE) WHEREAS, pursuant to a written contract between the (then) Village of Brooklyn Center and Mar -Kay Construction Company, Inc., the Glens Falls Insurance Company, as bonding agent, has satis- factorily completed the following improvement in accordance with said contract: Project No. 1965 -37B Construction of Well House #6 NOTE: The above referenced contract was duly signed by Mar -Kay Construction Company on March 21, 1966; subsequently, said company has become insolvent and the performance bond holder, Glens Falls Insurance Company, has effected the completion of the work. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center: 1. The work completed under said contract is hereby accepted and approved. 2. The value of work performed exceeded the original contract amount by $130.00 because of additional wallboard work and painting in the garage area. 3. It is hereby authorized that final payment may be made on said contract after November 27, 1967, upon taking the receipt of the bonding company in full, and obtaining from the referee of the bankrupt's estate, any necessary releases from liability. The total amount to be paid for said contract for said improvement project, including payments in full to the contractor, Mar -Kay Construction Company, and the bonding company, Glens Falls Insurance Company, is $25,305.50. November 27, 1967 The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, John Leary, Gordon Erickson Howard Heck and Theodore Willard, and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted.
