RESOLUTION NO. 67 -287
RESOLUTION APPROVING APPLICATIONS 67026 and 67027
SUBMITTED BY DARREL FARR
WHEREAS, Mr. Darrel Farr, a partner in a partnership consisting of
Mr. Farr, Mr. Fred M. Seed, and Mr. Bruce E. McNeil, has submitted
Applications #67026 and #67027, requesting, respectively, 1) approval of
the preliminary plat of "Twin Lake North Addition" encompassing the property
generally bounded by 60th Avenue (extended); the west lot lines of the
properties on the west side of June Avenue; 58th Avenue (Co. Rd. #10); and
the west City limits, and 2) rezoning of the property within the proposed plat
from the present R -1 Single Family Residence to R -3 Townhouse and R -5
Multiple Residence; and
WHEREAS, the Planning Commission has reviewed the requests
contained within these two Applications at public hearings, held pursuant to
published and mailed notice, on May 18, 1967, and at a subsequent meeting
held May 25, 1967, considering factors relating to the requests, especially
with relation to their effect on overall planning for the City, with which the
Planning Commission is charged, following which the Planning Commission
recommended approval of the two requests; and
WHEREAS, the City Council has reviewed the recommendation of the
Planning Commission with relation to the subject Applications, and has
gathered further information with regard thereto during the period of its
consideration of the requests, and is fully informed thereto.
NOW, THEREFORE, The City Council makes the following findings:
1) The City Council, in November of 1966, adopted a Comprehensive
Plan for the future development of the City, including therein the
intention that the property between County Road #10 and Kylawn
Park (the Farr property) be developed as high density housing
(north of County Road #10) and townhouses (south of Kylawn Park).
The development now proposed by Mr. Farr, that of townhouses
on the east portion of the property and multiple residences on the
west portion of the property, is not in disagreement with the general
goal described above.
2) The transitional device proposed by the developer in his "Plan C"
along the east side of the development, consisting of a landscaped
berm, will provide proper transition between the development and
the single family homes abutting it to the east.

31 The lake which the developer proposes to dredge on the property
has been shown to be a feasible concept through a hydraulic
study commissioned by the developer, and also is in accord with
long -range plans of the City with regard to maintenance of the
water levels of waterways throughout the watershed. To insure
perpetual use of this proposed lake as a means to water level
stabilization, however, the City will expect easements for
drainage over the proposed lake area and damming facilities.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
Brooklyn Center hereby approves:
a. the preliminary plat of "Twin Lake North Addition consisting of a
division into an easterly and westerly lot, which property is
presently described as Outlots 1, 2, 3, 4, and 5, Dahlen Addition;
and Lots 5, 6, 18, and 19, Auditor's Subdivision #216, Hennepin
County.
b. the rezoning of the property within the proposed plat of "Twin Lake
North Addition" as follows:
1) to be zoned R -3 Multiple Family Residence /Townhouse Lot 2
of Block 1, presently described as follows "All of Outlots 1
and 2 of Dahlen Addition and all of lot 6 of Auditor's Subdivision
No. 216, except the East 160 feet of said Lot 6, measured from
the centerline of June Avenue (the North, South and West
boundary are marked by judicial landmarks pursuant to Torrens
Case No. 13605, the East by judicial landmarks, said pursuant
to Torrens Case No. 12294). Also all of that part of Outlots 3
and 4 of Dahlen Addition, and all that part of Lots 5 and 18 of
Auditor's Subdivision No. 216; lying East of a line described as
commencing at the Northeast corner of Outlot 1 of Dahlen Addition,
thence West along the North line of Outlots 1 and 4 of said Dahlen
Addition, 570.79 feet for a point of beginning; thence Southerly
parrallel with the East line of said Outlots 1 and 2 of Dahlen
Addition, 1,322 feet to the Northerly right -of -way line of Bass
Lake Road (County Road No. 10). All of the above being located
in Section 3, Township 118 North, Range 21 West, Hennepin
County, Minnesota.
I I 2) to be zoned R -5 Multiple Family Residence/Walkup Outlots One
(1), Two (2), Three (3), Four (4) and Five (5) of Dahlen Addition
and Lots Five (5), Six (6), Eighteen (18) and Nineteen (19) of
j Auditor's Subdivision #216, Hennepin County, Minnesota. All
of the above, except all that part of Lots Eighteen (18) and
Nineteen (19) of Auditor's Subdivision #216, Hennepin County,
Minnesota, described as beginning at the intersection of the
West line of Bass Lake Road (also known as County Road #10)
and the South line of said Lot Nineteen (19); thence North along
said West line (also the northerly extension of the East line of
tracts A and B in Registered Land Survey #400) a distance of
33 feet; thence East along the North line of said Bass Lake Road
a distance of 15 feet; thence North and parallel with the Northerly
extension of the said West line of Bass Lake Road a distance of

117 feet; thence West and parallel with the South line of
said Lot Nineteen (19) for a distance of 260 feet; thence South
to a point in the South line of said Lot Nineteen (19) distant
245 feet West of the point of beginning; thence East to the
point of beginning. Also except the East 160 feet of Lot
Six (6) of said Auditor's Subdivision #216, also except that
part of Lot Eighteen (18) of said Auditor's Subdivision #216,
which is included in the plat of Pearson's Northport Fifth
Addition; also except that portion of Lot Nineteen (19) of said
Auditor's Subdivision #216 taken for road purposes; also except
that portion of Lot Eighteen (18) of said Auditor's Subdivision
#216 taken for drainage purposes; all of the above being subject
to a 15 foot utility easement, and except the following: "All
of Outlots 1 and 2 of Dahlen Addition and all of Lot 6 of Auditor's
Subdivision No. 216, except the East 160 feet of said Lot 6,
measured from the centerline of June Avenue (the North, South
and West boundary are marked by judicial landmarks pursuant
to Torrens Case No. 13605, the East by judicial landmarks,
said pursuant to Torrens Case No. 12294). Also all of that part
of Outlots 3 and 4 of Dahlen Addition, and all that part of Lots
5 and 18 of Auditor's Subdivision No. 216; lying East of a line
described as commencing at the Northeast corner of Outlot 1
of Dahlen Addition, thence West along the North line of Outlots
1 and 4 of said Dahlen Addition, 570.79 feet for a point of
beginning; thence Southerly parallel with the East line of said
Outlots 1 and 2 of Dahlen Addition, 1, 322 feet to the Northerly
right -of -way line of Bass Lake Road (County Road No. 10).
All of the above being located in Section 3, Township 118 North,
Range 21 West, Hennepin County, Mi esota.

member John Leary and upon vote being taken thereon, the
following voted in favor thereof: Philip Cohen, John Leary, Gordon Erickson,

whereupon said resolution was declared duly passed and adopted.
