HomeMy WebLinkAbout1967-135 CCR Member john Leary introduced the following resolution and moved its adoption: RESOLUTION NO. 67 -135 RESOLUTION DENYING APPLICATION NO. 67016 SUBMITTED BY MR. TERRY HARRINGTON WHEREAS, Mr. Jerry Harrington has submitted Application No. 67016 requesting approval of site and building plans for a multiple dwelling develop- ment in the southeast quadrant of the intersection of 65th and Camden Avenues North (Parcel 210, Plat 89036), which approvals are required by the City's Zoning Ordinance prior to the issuance of building permits for such development; and WHEREAS, the property in question is presently zoned 11 B -3 General Business District which zoning classification does not adopt as a permitted use (by reference), multiple dwellings, but only those uses actually described in Bl and B2; and WHEREAS, the City of Brooklyn Center has completed a lengthy compre- hensive planning study of the entire city, adopting a Comprehensive Plan on November 7, 1966, including therein a proposed land use plan indicating that the property included in Application No. 67016 be put to commercial rather than residential uses; and WHEREAS, during the consideration of the instant Application, the Council has viewed it in light of the Comprehensive Plan, to determine what effect this type of development (residential) would have on the community's overall plan for this area; and WHEREAS, the Council finds the following: 1. The application for plan approval submitted has been sub- mitted in error, as the B3 zoning on the property does not include multiple dwellings as a permitted use, as was apparently assumed by the City Staff in accepting the application, and the Planning Commission in approving the application. The Council finds, in fact, that the reference contained in the "permitted uses" section of the B3 zoning classification adopting the permitted uses of the B2 and B1 zones does not also adopt residential uses by a 2nd or 3rd reference contained in the "permitted uses" sections of the B2 and BI zones. 2. That even if the property had been zoned properly for multiple dwellings, the Comprehensive Plan presently in effect in the City of Brooklyn Center would be adversely affected by residential use of the property contained in Application No. 67016, and, in fact, the installation of such a use would preclude the orderly development of surrounding properties. i Resolution No. 67 -135 3. The concept of permitting residential uses within commercial zones is alien to commonly accepted planning principles upon which our Comprehensive Plan is founded, and, in fact, when a new zoning ordinance is adopted, to carry out the proposals of the Comprehensive Plan, the separation of these uses will be maintained. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Brooklyn Center hereby denies the approval of plans for a multiple dwelling development as requested in Application No. 67016 submitted by Jerry Harrington, and directs that no building permits be issued for construction of multiple dwellings on Parcel 210, Plat 89036.
