adoption:
RESOLUTION NO. 67 -138
RESOLUTION APPROVING APPLICATION NO. 67008 SUBMITTED
BY DAYTON DEVELOPMENT COMPANY FOR GOODYEAR TIRE
RUBBER COMPANY
WHEREAS, Dayton Development Company has submitted Application No.
67008 on behalf of one of its lessees, Goodyear Tire Rubber Co. requesting
a variance from Section 35 -330 of the city's ordinances to permit erection of a
freestanding sign on the property at 5501 Xerxes Avenue North (Tract M, R.L.S.
1209); and
WHEREAS, The Council has found in the past that hardship does in fact
exist in relation to freestanding signery on commercial properties, due to the
fact that the present zoning ordinance does not take into account this common
and necessary type of business activity (freestanding signing); and
WHEREAS, The Council, recognizing this deficiency in the present
zoning ordinance, has asked the Planning Commission to develop a sign
ordinance as part of the community's comprehensive planning study, which
the Planning Commission has done, said sign ordinance now undergoing study
by the Council; and
WHEREAS, The Council has reviewed the application submitted by
Dayton Development Co. in light of the standards for variances set out in
the zoning ordinances, the sign ordinance proposed by the Planning Commission,
the Planning Commission's recommendation on the instant application, and the
Council's own judgement as to freestanding signery; and
WHEREAS, The Council has developed a table of freestanding. sign
sizes in relation to gross floor area of commercial buildings which it feels is
a reasonable approach to the matter of freestanding signs for commercial establish-
ments which it proposes should be the basis of allocation of freestanding signs
in the forthcoming sign ordinance, which table has been referred to in making
a decision as to the instant application; and
WHEREAS, The Council finds that a hardship does in fact exist in the
application of the present zoning regulations relating to freestanding signs to
this property, which hardship satisfies the requirements for permitting a variance
from the zoning regulations:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center as follows:
1. a variance is hereby granted to permit the erection of a free-
standing sign on the Dayton Development Co. property at 5501
Xerxes Avenue, the sign area not to exceed 154 square feet, and
22.5 feet in height above the finished floor grade of the building
on the property.

The motion for the adoption of the foregoing resolution was duly seconded by
member Theodore Willard, and upon vote being taken thereon, the following
voted in favor thereof: Philip Cohen, john Leary, Howard Heck, Gordon
Erickson and Theodore Willard, and the following voted against the same:
none, whereupon said resolution was declared duly passed and adopted.
