and moved its adoption:
RESOLUTION NO. 67 -147
RESOLUTION APPROVING APPLICATION NO. 67012 SUBMITTED
BY CENTER DEVELOPMENT COMPANY
WHEREAS, Mr. Norman Chazin, a principal of Center Development
Company, has submitted Application No. 67012 requesting both a variance
from the 'City's Zoning Ordinance to permit a greater number of apartment
dwelling units on his RB zoned property than is permitted by the ordinance,
and also approval of the site and building plans of the apartment develop
ment to be built on Tract B, R. L. S. 1186; and
WHEREAS, the City Council has examined the facts and issues
relating to this Application, including the Planning Commission's recommenda-
tion thereon, and is fully informed therewith:
NOW, THEREFORE, BE IT RESOLVED that the following is the determina-
tion of the City Council with respect to Application No. 67012:
A. The site and building plans submitted by Center Development
Company for its apartment project are hereby approved, with
the following stipulations, conditions and alterations:
1. That the north line of this property be effectively screened
from the adjacent residential properties to its north by a
combination of garage walls, earth berm, and plantings as
follows:
a. A rolling, sodded earth berm adjacent to the property
dine, which, when viewed from the apartment property,
is at least 4 feet in height above the finished grade of the
apartment development's parking lot nearest the north
property line, and, when viewed from the adjacent residen-
tial properties to the north of the apartment development, is
at least 18 inches above the projected level of the adjacent
residential properties;
b. the north side of the berm shall be swaled (contoured)
to provide adequate drainage, and the swale shall meet
the grade of the adjacent residential properties so that
drainage shall not be directed onto the adjacent properties;
c. plantings of mixed deciduous and evergreen trees and
shrubs shall be installed atop the berm, to be densely
planted at least in those areas where the apartment develop-
ment's parking areas are easily visible from the residential
properties to the north;

d. flat roofed garages constructed in approximately the
positions designated on site plan submitted, with a
minimum of a 15 foot setback for such garages from the
north property line;
e. the screening devices shall not be installed within
15 feet of the Xerxes Avenue right -of -way line;
f. the vegetation contained within the strip of land
adjacent to the north property line shall be main-
tained in a verdant condition, and to aid in this main
tenance, sufficient water connections shall be installed
in proximity to the greenstrip to provide for its irrigation.
2. A revised site plan consistent with the requirements outlined
above and in accord with the site plan already approved shall
be submitted to the City Manager, including a landscaping
plan and planting schedule stating location, species, and size
of the trees and shrubs to be installed on the site.
3. The building plans submitted are subject to the approval of the
Building Inspector with relation to the applicable building codes.
4. No building permits are to be issued until satisfactory utilities
plans have been approved by the City Engineer.
5. That a performance agreement and performance bond (the amount
to be determined by the City Manager) be submitted to the City
to guarantee the site improvements set out in the plans submitted,
or required by ordinance.
B. A variance from the density requirements of the City's Zoning Ordinance
is hereby granted to permit the construction of 252 dwelling units within
the apartment development, rather than the 246 units otherwise permiss-
able, due to the unique topography of the property and its relationship
to adjoining residential properties, which has necessitated the require-
ment of screening, grading, and setback requirements beyond those
ordinarily required for apartment developments, and which has thereby
created a hardship to the apartment developer which satisfies the
standards for the issuance of variances fro the Zoning Ordinance.

The motion for the adoption of the foregoing resolution was duly seconded
by member Gordon Erickson, and upon vote being taken thereon, the
following voted in favor thereof: john Leary, Gordon Erickson and Howard
Heck,
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
