HomeMy WebLinkAbout1967-177 CCR Member Theodore Willard introduced the following resolution and moved its adoption: RESOLUTION NO. 67 -177 RESOLUTION REGARDING APPLICATION #67005 SUBMITTED BY BRUCE HASSELBERG WHEREAS, in February of 1967 Mr. Bruce Hasselberg made application for rezoning to B -2 (regional business) those parcels of property described as Tract A, Registered Land Survey #1082 and part of Government Lot 3 (Parcel 2910, Plat 89010); and WHEREAS, in the same application Mr. Hasselberg requested a special use permit for a service station use on those parcels of property so rezoned; and WHEREAS, subsequent to the submission of application #67005 the Planning Commission of the City of Brooklyn Center did hold a public hearing on the requests on March 2, 1967 resulting in a recommendation by the Commission to the City Council that both requests be denied; and WHEREAS, the City Council of the City of Brooklyn Center heard arguments both in favor of and against the proposed rezoning and special use on April 24 and May 29, 19 67 culminating an action by the Council on May 29, 1967 directing the City Manager and City Attorney to draft a resolution denying the rezoning request for the Council's consideration at its June 12th meeting. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota that it finds as follows: 1. One of the two parcels concerned in this application is zoned R -B (residence- business), and the other is zoned R -1 (single family residence). 2. The City Council did adopt on November 7, 1966, a Comprehensive Plan for the City of Brooklyn Center, which contains the policy decision that these parcels and adjacent parcels to the south and west should be put to multiple residential use. The Comprehensive Plan adopted by the City Council represents more than two years work by a professional planner engaged by the City, as well as many months extensive and detail review by the City's Planning Commission, staff, and the City Council. 3. During the development of the City's Comprehensive Plan, residents and property owners in the surrounding neighborhood played a significant role in the formation and development of the Comprehensive Land Use Plan. Therefore, the opinions of affected property owners in the vicinity of the requested zoning should be, and have been, considered as factors in the Council's determination. RESOLUTION NO. 67 -177 4. The owners of properties adjoining the property for which rezoning is ^requested are opposed to such rezoning on the basis that the previous zonings within the vicinity were premised on the land use concept that all properties west of France Avenue and south of Trunk Highway #100 would be zoned and used for office or apartment uses, and that said owners relied on this concept in investing in and improving their property. 5. If application #67005 requested a zoning change from R -1 and R -B to R -5 which would be consistent with the objectives of the Comprehensive Plan, the then new zoning would be adequate and proper and would permit the best use of the property. 6. It is admitted by one of the owners that the property was purchased for an office type building use. Being a well qualified land developer and contractor it is assumed he made the purchase after careful study and evaluation. However, even if such is not the case, zoning of the entire community was effected to protect property values by preserving the character of respective districts and by insuring their orderly development. The zoning comprehended by the Comprehensive Plan will prevent congestion and will tend to assure adequate sun light, air and freedom from noise and odors and it will tend to promote stability and orderliness in community development through the extension of the residential elements to the south of the subject property. The denial of this application will accomplish such objectives and the health safety and general welfare of the City will best be served by such denial. BE IT FURTHER RESOLVED, that as a result of the facts considered during its deliberations and the findings contained above the City Council of the City of Brooklyn Center hereby denies the rezoning to B -2 requeste in application #67005.
