moved its adoption:
RESOLUTION NO. 67 -178
RESOLUTION RETECTING SPECIAL USE PERMIT APPLICATION #67005
WHEREAS in February of 1967 Mr. Bruce Hasselberg made application
for rezoning to B -2 (regional business) those parcels of property described as
Tract A, Registered Land Survey #1082 and part of Government Lot 3 (Parcel
2910, Plat 89010); and
WHEREAS, in the same application Mr. Hasselberg requested a special
use permit for a service station use on those parcels of property so rezoned;
and
WHEREAS, subsequent to the submission of application #67005 the
Planning Commission of the City of Brooklyn Center did hold a public hearing
on the requests on March 2, 1967 resulting in a recommendation by the Commission
to the City Council that both requests be denied; and
WHEREAS, the City Council of the City of Brooklyn Center heard arguments
both in favor of and against the proposed rezoning and special use on April 24
and May 29, 19 67 culminating an action by the Council on May 29, 1967
directing the City Manager and City Attorney to draft a resolution denying the
rezoning request for the Council's consideration at its June 12th meeting.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center to reject that portion of application #67005 relative to a special
use permit on the basis that the present zoning classification of the subject
property does not permit the operation of an automobile service station and the
applicants' request is therefore not appropriately before the Council.

The motion for the adoption of the foregoing resolution was duly seconded by
member Theodore Willard and upon vote being taken thereon,
the following voted in favor thereof; Philip Cohen, John Leary, Howard Heck
and Theodore Willard,
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
