RESOLUTION NO. 67 -180
RESOLUTION PERTAINING TO.SANITARY SEWER,
CITY WATER STREET SURFACING TO SERVE
CERTAIN BROOKLYN PARK PROPERTIES ALONG
73rd AVENUE BETWEEN LOGAN AVENUE AND HUMBOLDT AVENUE
WHEREAS, the center line of 73rd. Avenue North is the boundary
between the City of Brooklyn Center and. the Village of Brooklyn Park
in the area. between Logan Avenue North and, Humboldt Avenue North; and.
WHEREAS, the City of Brooklyn Center has opened, bids and
awarded. a. contract calling for the installation of sanitary sewer
and city water in said. segment of 73rd. Avenue North; and.
WHEREAS, the City of Brooklyn Center intends to complete a
regrading and, resurfacing of 73rd. Avenue North between Logan Avenue
North and. Humboldt Avenue North at a later date within the 1967
construction season? and.
WHEREAS, the City of Brooklyn Center agrees that they will
allow the abutting Brooklyn Park properties to hook up to tl- esaid,
sanitary sewer and, water main;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Brooklyn Center as follows:
1. Residential building sites in the Village of Brooklyn Park
which abut 73rd. Avenue between Logan Avenue North and. Humboldt Avenue
North shall be allowed. to connect directly to the Brooklyn Center
sanitary sewer system and, Brooklyn Center water main in 73rd. Avenue
subject to the terms and, provisions of this resolution.
2. The cost of service to the property owners of Brooklyn Park
will be the same as the cost to the average Brooklyn Center property
owner in this area and are estimated, as follows:
Sanitary Sewer
Interceptor sewer assessment $2.16 per lin. ft.
Lateral sewer assessment 6.14 per lin. ft.
$8.30 per lin. ft.
Total estimated, sewer cost:
1,259.27 lin. ft. Cam? $8.30 per ft. $10,451.94.

Total assessment per complete
installation to the property line: $490.00
Total water cost:
9 1" services $490.00 $4,410.00
Street
Grading and paving 3.05 per lin. ft.
Total estimated, street cost:
1,360 lin. ft. $3.05 per ft. $4,148.00
3. The installation charge for sanitary sewer, water and
street work shall be paid, by the Village of Brooklyn Park to the
City of Brooklyn Center upon completion of the work. A statement
of charges will be computed and, forwarded by the City of Brooklyn
Center to the Village of Brooklyn Park at that time.
4. The sewer use rate charged Brooklyn Park residential property
owners will be the current rate charged to Brooklyn Center property
owners, presently $4.50 per quarter, said rate to be billed. directly
to Brooklyn Park property owners by the City of Brooklyn Center.
Payment of the sewer use charges to Brooklyn Park property owners is
guaranteed, by the Village of Brooklyn Park.
5. The water charge to Brooklyn Park residential property
owners will be the current rate charged, to Brooklyn Center property
owners, presently $0.35 per 1000 gallons, said, rate to be billed
directly to Brooklyn Park property owners by the City of Brooklyn
Center. Payment of the water rate charges to Brooklyn Park property
owners is guaranteed, by the Village of Brooklyn Park.
6. Individual property owners in Brooklyn Park shall acquire
a standard, sewer and. water connection permit from the City of
Brooklyn Center prior to making any connections to the sewer or
water systems.
7. Property owners in the Village of Brooklyn Park connecting
directly to the Brooklyn Center water or sewer systems shall abide
by the City of Brooklyn Center rules and regulations regarding said.
connections.
8. Brooklyn Center shall not be responsible to any person,
firm or corporation for damages claimed, as a result of the backing
up of sewers in any basement in Brooklyn Park.

9. This resolution shall take effect and be in force upon
adoption by the Village of Brooklyn Park and the City of Brooklyn
Center.
BE IT FURTHER RESOLVED, that the Mayor and City Manager of the
City of Brooklyn Center are hereby authorized to execute an agree-
ment with the Village of Brooklyn Park, according to the general
terms set forth in this resolution.

The motion for the adoption of the foregoing resolution was duly
seconded by member John Leary and upon vote being taken
thereon, the following voted in favor thereof: Philip Cohen, Howard
Heck, John Leary, and Theodore Willard,
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted,
