HomeMy WebLinkAbout1967-039 CCR Member John Leary introduced the following resolution and moved its adoption: RESOLUTION NO. 67 -39 RESOLUTION AMENDING AGREEMENT BETWEEN THE CITY OF BROOKLYN CENTER, MINNESOTA AND THE VILLAGE OF BROOKLYN PARK, MINNESOTA RELATIVE TO THE INTER CONNECTION OF SEWERS WHEREAS, the (then) Village of Brooklyn Center, Minnesota and the Village of Brooklyn Park, Minnesota entered into an agreement entitled "Agreement Between the Village of Brooklyn Center, Minnesota and the Village of Brooklyn Park, Minnesota Relative to the Interconnection of Sewers", effective October 19, 1961; and WHEREAS, section VII of the above sited agreement was amended by Brooklyn Center Resolution No. 65 -9 dated January 18, 1965 which resulted in lower rates to Brooklyn Park; and WHEREAS, the City of Brooklyn Center through the Suburban Sanitary Sewer Commission has successfully negotiated a new sewage disposal contract with the City of Minneapolis; and WHEREAS, in order to be consistent with the provisions of the new contract between the City of Brooklyn Center and the City of Minneapolis it is desirable and equitable to again amend the agreement between Brooklyn Center and Brooklyn Park relative to the interconnection of sewers: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota that Brooklyn Center Resolution No. 65 -9 adopted January 18, 1965 and that section VII of the agreement entitled "Agreement Between the Village of Brooklyn Center, Minnesota and the Village of Brooklyn Park, Minnesota, Relative to the Interconnection of Sewers" dated October 19, 1961 be amended to read as follows: "For the privilege of discharging its sewage into the Brooklyn Center sewer system, Brooklyn Park shall pay to Brooklyn Center a sewer charge per 1000 gallons of sewage discharged into the Brooklyn Center sewer system, which charge shall be composed of the following cost elements: (1) The current prevailing cost of disposing of sewage into the Minneapolis sewer system and into the Minneapolis St. Paul Sanitary District facilities, exclusive of capital costs for interceptor and joint use sewer capacity. This cost shall be computed by dividing the current Minneapolis charges to Brooklyn Center, exclusive of interceptor and joint use sewer capital costs, by the corresponding period metered and direct sewage flow into the Minneapolis sewer system from Brooklyn Park and Brooklyn Center combined. Resolution No. 67 -39 (2) The cost of maintenance and operation of lift stations within the Brooklyn Center system. This cost shall be computed by dividing the previous calendar year pumping costs (as determined by audit report) by the corresponding period total sewage volume discharged from Brooklyn Park and Brooklyn Center combined. (3) The cost of maintaining joint use sewer lines within Brooklyn Center. This cost shall be computed by multiplying the previous calendar year transmission costs (as determined by audit report) by the corresponding period ratio of miles of joint use sewer mains to miles of total sewer mains in Brooklyn Center; the product shall be divided by the corresponding period total sewage volume discharged from Brooklyn Park and Brooklyn Center combined. (4) The cost of administering the Brooklyn Center sewer system. This cost shall be computed by dividing the previous calendar year administration costs (as determined by audit report) by the corresponding period total sewage volume discharged from Brooklyn Park and Brooklyn Center combined. (5) The cost of depreciation of the joint use sewer facilities within the Brooklyn Center sewer system. This cost shall be computed by dividing the annual, one percent, straight line depreciation cost of joint use facilities by the corresponding period sewage volume discharged from Brooklyn Park and Brooklyn Center combined. In addition, Brooklyn Park shall pay to Brooklyn Center a flat amount of $125.00 per quarter for accounting and record keeping pertaining to the sewer inter connection. Further, Brooklyn Park shall pay to Brooklyn Center rental charges for a share of Brooklyn Center's capacity in the Minneapolis joint use sewer system and in the Minneapolis -St. Paul Sanitary District sewer system, according to the attached Schedule 16. This amendment shall be considered effective as of September 30, 1965. BE IT FURTHER RESOLVED, that said amendment be conditioned upon passage of this resolution by the City Council of Brooklyn Center and the Village Council of Brooklyn Park. Certified copies of this resolution, as and when adopted, shall be filed with the City Clerk of Brooklyn Center and the Village Clerk of Brooklyn Park immediately after such adoption.
