and moved its adoption:
RESOLUTION NO. 67-40
RESOLUTION CREDITING BROOKLYN PARK FOR PREVIOUS
SEWER CAPITAL PAYMENTS
WHEREAS, the (then) Village of Brooklyn Center, Minnesota and the
Village of Brooklyn Park, Minnesota entered into an agreement entitled
"Agreement between the Village of Brooklyn Center, Minnesota and the Village
of Brooklyn Park, Minnesota Relative to the Interconnection of Sewers
effective October 19, 1961; and
WHEREAS, Section VII of the above sited agreement was amended by
Brooklyn Center Resolution No. 65 -9 dated January 18, 1965 which resulted
in lower rates to Brooklyn Park; and
WHEREAS, the City of Brooklyn Center through the Suburban Sanitary
Sewer Commission has successfully negotiated a new sewage disposal contract
with the City of Minneapolis; and
WHEREAS, Section VII of the October 19, 1961 agreement was amended
by Brooklyn Center Resolution No. 67 -39 dated February 27, 1967 in a manner
consistent with the provisions of the new contract between the City of Brooklyn
Center and the City of Minneapolis; and
WHEREAS, the new contract between Brooklyn Center and Minneapolis
provides a credit to Brooklyn Center in the amount of $131,670.00 against the
purchase of capacity in the jointly used sewer system of Minneapolis, said
credit consisting of previous payments by Brooklyn Center for amortization,
fixed capital costs, and capital outlay; and
WHEREAS, it has been established that $18,300.00 of the $131,670.00
credit is attributable to payments by the Village of Brooklyn Park; and
WHEREAS, under the terms of the new sewage disposal contract the
Village of Brooklyn Park will not be purchasing sewer capacity in the jointly
used sewer system of Minneapolis; and
WHEREAS, the Village of Brooklyn Park, according to the terms of
Resolution No. 67 -39, will be renting sewer capacity from the City of Brooklyn
Center.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of
Brooklyn Center to grant to the Village of Brooklyn Park credit in the amount
of $18, 300.00 against charges made by Brooklyn Center against Brooklyn Park
for sewage flows during 1967.

The motion for the adoption of the foregoing resolution was duly seconded
by member Gordon Erickson and upon vote being taken thereon, the
following voted in favor thereof: Howard Heck, john Leary, Gordon Erickson
and Theodore Willard,
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
