and moved its adoption:
RESOLUTION NO. 67 -56
RESOLUTION OPPOSING THE ADOPTION OF HOUSE FILE
575 AND SENATE FILE 437 PERTAINING TO THE EXPANSION
OF REGULATION OF FOOD ESTABLISHMENTS BY THE
DEPARTMENT OF AGRICULTURE
WHEREAS, Senate File 437 and its companion bill House File 575 are
purported to be legislative proposals which would clarify present provisions
of the law and make the proper administration of the present law more feasible;
and
WHEREAS, the provisions of these proposals would in fact expand the
authority of the State Department of Agriculture into areas of regulation and
control already assigned to the State Department of Health and local health
agencies, thus compounding the existing duplication of regulation in the
field of public health; and
WHEREAS, the proposed legislation would unnecessarily impose added
control and licensing requirements upon restaurants and vending facilities:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center as follows:
1. The City Council is opposed to the concepts embodied in

of the authority of the State Department of Agriculture in the
field of public health, and the representatives of the people
of Brooklyn Center are herewith urged to work for the defeat of
this proposed legislation.
2. The Governor of the State of Minnesota, as head of the
executive branch of government, is respectfully petitioned to
initiate a reorganization of state administrative and regulatory
activities in the field of public health which would accomplish
the following:
a. Remove the duplication of inspection and licensing of
food establishments by both State and local health
authorities from such activities when the local health
agency is conducting a satisfactory and effective food
sanitation program, as determined by the State Depart-
ment of Health.
b. Establish the State Department of Health as an advisory
and supervisory agency in regard to effective local
health agencies, and equip and staff the Department of
Health for technical support activities.

c. Remove the cause for jurisdictional disputes between
the State Departments of Health and Agriculture by
clearly assigning regulatory authority over the pro-
duction and wholesale distribution of foodstuffs to
the Department of Agriculture, and assigning regulatory
authority to the Department of Health in the area of
retail food sales, processing and dispensation.
3. The Clerk is hereby directed to transmit copies of this resolution
to the Governor of the State of Minnesota, the representatives
of the people of Brooklyn Center in the Senate and House of
Representatives, and to the chairmen of the appropriate legis-
lative committees.

The motion for the adoption of the foregoing resolution was duly seconded
by member John Leary, and upon vote being taken thereon, the
following voted in favor thereof: Philip Cohen, John Leary, Howard Heck,
Gordon Erickson and Theodore Willard,
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
