HomeMy WebLinkAbout1967-064 CCR Member Gordon Erickson introduced the following resolution and moved its adoption: RESOLUTION NO. 67 -64 RESOLUTION SUPPORTING LEGISLATION WHICH WOULD REMOVE THE STATUTORY ON FEES FOR OFF -SALE AND CLUB LIQUOR LICENSES AND OFF -SALE NON INTOXICATING MALT LICENSES WHEREAS, current statutes establish maximum fees which a municipality may impose upon off -sale liquor, club liquor and off -sale non intoxicating malt licenses; and WHEREAS, the differing conditions in the several municipalities of the state lead to a differential cost of enforcement and regulation of such licensed establishments, but this differential is not recognized by the statutory limits; and WHEREAS, it has been established both in custom and at law that the fee imposed for a regulatory or control license should be reasonably related to the costs incurred by the municipality for such control and regulation; and WHEREAS, the present statutory limits inhibit the municipality from establishing an equitable policy as regards license fees by removing from the council the power to establish equitable fees for the above noted licenses: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center as follows: 1. The City Council supports and endorses the adoption of legislation which would permit the local municipality to establish just and equitable license fees for off -sale liquor licenses, club liquor licenses and off -sale non intoxicating malt beverage licenses, and therefore the Council urges the adoption of H. F. 709 S. F. 852 and H. F. 710 S. F. 849. 2. The representatives of the people of Brooklyn Center are herewith called upon to work for the adoption of this legislation and the City Clerk is hereby directed to transmit copies of this resolution to the representatives of Brooklyn Center in the House of Representative and Senate, the Governor of the State of Minnesota, and the chairmen and membership of the appropriate legislative committees.
