and moved its adoption:
RESOLUTION NO. 67 -79
RESOLUTION SUPPORTING THE ADOPTION OF HOUSE FILE
1184 AND SENATE FILE 500 RELATIVE TO THE ESTABLISHMENT
OF A METROPOLITAN MULTI PURPOSE SERVICE DISTRICT,
AND CALLING FOR CERTAIN AMENDMENTS THERETO
WHEREAS, the seven county Minneapolis -St. Paul metropolitan area
constitutes one social and economic community, although it is fragmented
into a vast number of political communities and service districts; and
WHEREAS, although many of the services provided by government,
and the policy decisions of smaller political units can and should be effected
by the local unit of government, several of the functions of local government
can be properly accomplished only on a total area basis comprehending all
of the existing political and service units; and
WHEREAS, Senate File 500 and its companion measure House File 1184
propose the establishment of a multi purpose service district for the metropolitan
area, which district would operate in the areas of sewage disposal, metropolitan
planning, mosquito control and mass transit; and
WHEREAS, the proposed district would be governed by a metro council,
the membership of which would be directly elected by the voters of the metro-
politan area; and
WHEREAS, the City Council finds that such a multi purpose service
district would be of major benefit to the entire metropolitan area, and concurs
in the establishment of such a district and in the mode of representation out-
lined above, but it is the opinion of the City Council that such a district should
be assigned functional responsibility in the area of civil defense coordination,
air pollution control, and solid waste disposal, in addition to the responsibilities
outlined above; and
WHEREAS, in order to provide an equitable and just mode of appeal
from the actions of the proposed metro council, the City Council is of the
opinion that the subject legislation should include a provision for judicial
review of orders of the metro council which may be challenged as being arbitrary,
capricious or unreasonable:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center as follows:
1. The City Council endorses and supports the concepts embodied
in Senate File 500 and House File 1184, and urges the State
Legislature to adopt this legislation after including provisions
to effect the following:

a. Protection of minority rights by providing for judicial
review of orders of the metro council which may be
challenged as arbitrary, capricious or unreasonable;
b. assignment of functional responsibility to the district
for the coordination of civil defense activities, air
pollution control and solid waste disposal
c. elimination of any distance influence on cost factors
relative to the Metropolitan Sanitary Sewer District
feature.
2. The representatives of the people of Brooklyn Center in the
Senate and House of Representatives are herewith urged to
work for the adoption of this legislation.
3. The Clerk is hereby directed to transmit copies of this resolution
to the aforementioned representatives, the Governor of the State
of Minnesota, the Hennepin County Legislative Delegation, and
the chairmen of the appropriate legislative committees.

The motion for the adoption of the foregoing resolution was duly seconded
by member Gordon Erickson and upon vote being taken thereon, the
following voted in favor thereof: Philip Cohen, Howard Heck, Gordon
Erickson and Theodore Willard,
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
