Member Theodore Willard introduced the following resolution
and moved its adoption:
RESOLUTION NO. 66 247
RESOLUTION DENYING APPLICATION NO. 66023 SUBMITTED
BY THOMAS WILDER, REQUESTING REZONING OF CERTAIN
PROPERTIES WEST OF OSSEO ROAD AND NORTH OF 71st
AVENUE NORTH FROM R -1 TO R -3 AND R -5
WHEREAS, since June of 1965, Thomas Wilder has instituted three
rezoning requests concerning the same general area of the Northwest Neighbor-
hood of the Village, such properties lying west of Osseo Road and (generally)
north of 71st Avenue; and
WHEREAS, the first two of these requests (Applications No. 65050 and
66002) requested rezoning from the existing R -1 (single family residence)
zoning classification to RB and R -5, two zones whose primary permitted use is
multiple family dwellings; and
WHEREAS, the first two rezoning requests were duly heard by the
Planning Commission and thereafter heard and denied by the Village Council;
and
WHEREAS, the most recent of these three applications, to which this
resolution is directed, was brought by Mr. Wilder requesting rezoning of parcels
6223, 5400,5800, and that portion of parcel 5600 lying north of the south 150
feet thereof to R -5 (2 1/2 story apartments) and the south 150 feet of parcel
5600 to R -3 (townhouses), all of these parcels lying within Auditor's Subdivision
No. 57; and
WHEREAS, the Planning Commission held a public hearing on Application
No., 66023 on April 14, 1966, proper legal notice of such hearing having been
made, and following the public hearing on the matter, made its recommendation
to the Village Council; and
WHEREAS, the Village Council did, on April 25, 1966, hold a hearing
on Application No. 66023, and following consideration of the Planning Commission's
recommendation and comments from those interested parties in attendance, the
hearing was closed and action on the application was tabled; and
WHEREAS, during the period in which the Application was tabled, the
Village Council determined that it would be in the best interests of all concerned
to engage Hodne Associates, Inc., as a planning Consultant to examine said
application including taking into consideration the comprehensive planning
study completed for the Village in September of 1965; and
WHEREAS, as a result of having studied all of the issues involved
with Application No. 66023, including the report prepared by its planning
consultant, the Village Council finds the following:
Resolution No. 66 -247
1. That the requested rezoning is incompatible with the
existing single family residential uses of surrounding
properties;
2. That the requested rezoning is incompatible with, and
contrary to, the proposals for the area contained in the
Comprehensive Plan of the Village prepared by the
Planning Commission and its planning consultant; and
recently reviewed by the planning consultant in relation
to this application;
3. That no substantial change has occurred which affects the
suitability of this property for use under the present zoning
ordinance:
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center that it finds the present zoning of the applicant's
property is consistent with the planning and zoning principles followed by
the municipality, and that the health, safety and general welfare of the
Village will best be served by denying Application No. 66023.

The motion for the adoption of the foregoing resolution was duly seconded
by member John Leary and upon vote being taken thereon, the
following voted in favor thereof: Philip Cohen, John Leary,
Earl Simons and Theodore Willard;
and the following voted against the same: None;
whereupon said resolution was duly passed and adopted.
