and moved its adoption:
RESOLUTION NO. 66 -278
RESOLUTION VACATING A PORTION OF NOBLE AVENUE
BETWEEN OSSEO ROAD AND 71st AVENUE NORTH
WHEREAS, a majority of owners of the land abutting property in
Hennepin County, Minnesota have petitioned for the vacation of said
property described as follows:
That portion of Noble Avenue which abuts that part of Lot 24,
Auditors Subdivision Number 57, Hennepin County, Minnesota
and lying east of the easterly right -of -way line of Osseo Road;
which is also described as that part of Section 27, T 119, R 21,
and Section 28, T 119, R 21, Hennepin County, Minnesota.
Beginning at a point in the East line of said Section 28, distant
957.75 feet south from the East 1/4 corner of said Section 28,
(said East line assumed at bearing South); thence South 55 21'
30" West 40.11 feet; thence South 117.90 feet; thence South
34 38' 30" East, 116.11 feet; thence North 259.03 feet; thence
South 55 21' 30" West, 40.11 feet to the point of beginning. and
WHEREAS, two weeks' published notice and posted notice of a hearing
on said petition on May 16, 1966 at 8 :00 P.M. has been given and made, and
a hearing thereon has been had by the Village Council:
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Hennepin County, Minnesota, that:
"That portion of Noble Avenue which abuts that part of Lot 24,
Auditors Subdivision Number 57, Hennepin County, Minnesota and
lying east of the easterly right -of -way line of Osseo Road; which
is also described as that part of Section 27, T 119, R 21, and
Section 28, T 119, R 21, Hennepin County, Minnesota. Beginning
at a point in the East line of said Section 28, distant 957.75 feet
south from the East 1/4 corner of said Section 28, (said East line
assumed at bearing South); thence South 55 21' 30" West 40.11
feet; thence South 117.90 feet; thence South 34 38' 30" East,
116. 11 feet; thence North 259.03 feet; thence South 55 21' 30"
West, 40. 11 feet to the point of beginning", as the same is
recorded in the office of the Register of Deeds of Hennepin County, Minnesota,
be hereby vacated; provided that said Village excepts from this vacation
proceedings and reserves to itself and its assigns an easement for all public
utility purposes, including without limiting the general nature of said reser-
vation, an easement for electric, gas, sewer, water and telephone equipment
on, over and under the property above described vacated. If

The motion for the adoption of the foregoing resolution was duly seconded
by member Theodore Willard, and upon vote being taken thereon the
following voted in favor thereof: Philip Cohen, Earl Simons, Howard Heck,
John Leary and Theodore Willard,
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
