Member John Leary introduced the following resolution and
moved its adoption:
RESOLUTION NO. 66 -318
RESOLUTION AUTHORIZING REAPPORTIONMENT OF SPECIAL
ASSESSMENTS AND DIRECTING THE COUNTY AUDITOR TO
CANCEL A PORTION THEREOF RE: LOTS 18 19, AUDITOR'S
SUBDIVISION NO. 310
WHEREAS, the platting of Lot 18, Auditor's Subdivision No. 310 and
the South 75 feet of the East 400 feet of Lot 19, Auditor's Subdivision No.
310 into Shell's Brooklyn Center Addition specified the dedication of the
north 66 feet of the south 75 feet of the east 400 feet of Lot 19 as street
right of way; and
WHEREAS, the parcel described as the south 75 feet of the east
400 feet of Lot 19, Auditor's Subdivision No. 310, has outstanding special
assessments in the amount of $745.43 owing thereon;, and
WHEREAS, the Village of Brooklyn Center is receiving income from
rental property presently located on said future street right of way
NOW, THEREFORE BE IT RESOLVED, by the Village Council of the
Village of Brooklyn Center to reapportion the unpaid special assessments
applicable to the 66 feet street right of way and to the 9 feet residue of
the aforementioned parcel; and
BE IT FURTHER RESOLVED to cancel the portion of unpaid special
assessments applicable to said street right of way from the Hennepin County
Tax Rolls and to set up same for payment through the Village Finance office
in accordance with established Village policy; and
BE IT FURTHER RESOLVED, that the County Auditor is authorized and
directed to cancel the amounts of the special assessments on Parcel 2100,
Auditor's Subdivision No. 310 as follows:

BE IT FURTHER RESOLVED, to direct that the income from the rental
property located on said future street right of way be assigned to reimburse
the bond funds to the extent of the cancelled special assessments or portion
thereof received prior to disposition of said rental property.

The motion for the adoption of the foregoing resolution was duly seconded
by member Theodore Willard and upon vote being taken thereon, the
following voted in favor thereof: Philip Cohen, Earl Simons, john Leary,
Howard Heck and Theodore Willard,
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
