and moved its adoption:
RESOLUTION NO. 66 -178
RESOLUTION DENYING APPLICATION NUMBER 66036
SUBMITTED BY DONALD C. STARK FOR A SPECIAL USE
PERMIT
WHEREAS, Donald C. Stark has applied for the issuance of a special
use permit to permit the construction of a two- family dwelling on the parcel
described as Parcel 5800, Section 36, Brooklyn Center, said application
being numbered 66036; and
WHEREAS, on June 2, 1966 the Planning Commission held a public
hearing on the subject application pursuant to mailed notice to all parties
within 150 feet of the subject property, and subsequently made its recommenda-
tion to the Village Council; and
WHEREAS, on June 8, 1966, at a special meeting attended by all
members of the Village Council after proper notice, the Village Council con-
sidered the application and the recommendations of the Planning Commission,
as well as comments by the applicant and interested persons in attendance; and
WHEREAS, as a result of the aforementioned consideration, the Village
Council finds:
1. That the issuance of the special use permit would be
injurious to the use and enjoyment of other properties
in the immediate vicinity.
2. That the issuance of the requested special use permit
would substantially impair and diminish the values of
properties in the immediate vicinity.
3. That the issuance of the special use permit would impede
the normal and orderly development and improvement of
surrounding property for uses permitted in the district.
4. That adequate conditions and restrictions for the
requested permit cannot be devised to protect the
public interest and secure compliance with the require-
ments of the Village Ordinances.
NOW, THEREFORE, BE IT RESOLVED that the Village Council deny
Application Number 66036 submitted by Donald C. Stark for the issuance
of a special use permit to allow the construction of a two-family dwelling

on the parcel described as Parcel 5800, Section 36, Brooklyn Center,
Minnesota.

The motion for the adoption of the foregoing resolution was duly seconded
by member Howard Heck and upon vote being taken thereon, the
following voted in favor thereof: Philip Cohen, John Leary, Earl Simons,
Howard Heck and TheodoreWillard,
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
