its adoption:
RESOLUTION NO. 66 -179
RESOLUTION ORDERING A CERTAIN BUILDING LOCATED AT
500 55TH AVENUE NORTH, BROOKLYN CENTER, MINNESOTA
TO BE RAZED AND REMOVED
WHEREAS, Twin City Federal Savings and Loan Association is the owner of
a certain building located at 500 55th Avenue North, Hennepin County, Minnesota,
and
WHEREAS, this building is best described as an abandoned basement
containing refuse and debris; and
WHEREAS, after numerous complaints, Mr. Jean Murphey, the Chief
Building Inspector of the Village of Brooklyn Center, on the 10th day of June, 1966
inspected the subject property and submitted his report to the Village Council,
which described the premises as generally abandoned in a dilapidated and extreme
state of disrepair; stating that it is of generally unsightly appearance, that it
violates the Building Code of the Village of Brooklyn Center in that the structure
has been substantially consumed by fire, that unsafe conditions exist which could
result in personal injury to any person on or near the property, that it is an
attractive nuisance for children, that several types of combustables are located
on the property which could cause an explosion, fire or other contamination,
and that in the opinion the building is beyond repair; and
WHEREAS, it should be noted that the Brooklyn Center Fire Department
after receiving permission from the owner, and after the house and garage structures
on the property were more than fifty per cent damaged and destroyed by fire,
did raze the house and garage structure to its present state; and
WHEREAS, the Council of the Village of Brooklyn Center finds that the
above described building is inadequately maintained, dilapidated and in a state
of extreme disrepair, is in an unsanitary condition, constitutes a hazard to
the public safety, a menace to public health and a fire hazard, and violates the
Building Code;
NOW, THEREFORE BE IT RESOLVED that Twin City Federal Savings and
Loan Association shall be ordered to raze and remove the dilapidated and
abandoned basement, remove all debris resulting from such removal and to
fill any such excavation remaining therefrom, located at 500 55th Avenue North,
Brooklyn Center, Minnesota on the property legally described as:
The East 82.5 feet of Lot 48, Garcelon's Addition to
Minneapolis, Hennepin County, Minnesota

And that this action is being taken pursuant to Minnesota Statutes Annotated
ss. 463,15 463.26 on the grounds that said building is a hazardous building
within the meaning of that statute;
BE IT FURTHER RESOLVED that Twin City Federal Savings and Loan
Association, or its heirs or assigns, must comply with this order within twenty
(20) days from the date of service thereof, or within twenty (20) days file an
answer thereto, otherwise a motion for summary enforcement of this order will
be taken by the Village of Brooklyn Center in the Hennepiji County District Court.

The motion for the adoption of the foregoing resolution was duly seconded
by member TheodoreWillard and upon vote being taken thereon the
following voted in favor thereof: Philip Cohen, Earl Simons, John Leary,
Howard Heck and TheodoreWillard,
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
