and moved its adoption:
RESOLUTION NO. 66 -218
RESOLUTION DENYING APPLICATION 66046 SUBMITTED
BY CENTER SALES, INC.
WHEREAS, Center Sales, Inc. has submitted Application 66046
for a variance from Section 35 -701 to allow paving of and parking on the
property within 15 feet of the highway right -of -way; and
WHEREAS, the Planning Commission held a public hearing on
June 9, 1966 and subsequently made its recommendation to the Village
Council that the application be denied; and
WHEREAS, on June 16 and July 11, the Village Council was advised
regarding the application and after duly considering the statement made by
the applicant and his attorney, the records and files concerning the property,
made the following findings:
1. That applicant entered into an agreement in the approval
of site and plot plans in which he agreed to provide the 15
foot green strip, and to insure the performance thereof, filed
a surety bond with the Village of Brooklyn Center in the
amount of $2,000.00 on November 1, 1965 subject to com-
pletion of improvements by July 1, 1966.
2. That in reliance on said agreement and bond, the Village
of Brooklyn Center issued a Certificate of Occupancy, The
privileges of which the applicant has enjoyed since that time;
3. That there are no unique conditions in the application not
applicable, generally, to other property;
4. That the application is based exclusively on a desire to
increase the income potential of the land;
5. That granting the variance would be detrimental to the public
welfare and may be injurious to other land or improvements in
the neighborhood in which the parcel of land is located;
6. The proposed variance would tend to substantially diminish
or impair property values within the neighborhood;
7. That there are no unique conditions of shape, topography or
other unique features of the land which, taken into conjunction
with the provisions of the Village Ordinances, create a hardship.
NOW, THEREFORE, BE IT RESOLVED that the Village Council deny
application No. 66046 on the findings enumerated above and that the health,
I safety and general welfare of the Village will best be served thereby.

The motion for the adoption of the foregoing resolution was duly seconded
by member John Leary and upon vote being taken thereon,
the following voted in favor thereof: Philip Cohen, Earl Simons, John
Leary, Howard Heck and Theodore Willard,
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
