and moved its adoption:
RESOLUTION NO. 66 -221
RESOLUTION REQUESTING THE INTRODUCTION OF LEGISLATION
IN THE CONGRESS OF THE UNITED STATES FOR THE PURPOSE OF
REIMBURSING THE VILLAGE OF BROOKLYN CENTER FIFTY PERCENT
OF THE COSTS OF CERTAIN CIVIL DEFENSE EOUIPMENT
WHEREAS, on or about April 4, 1963, the Brooklyn Center Civil Defense
organization submitted a project application through appropriate Civil Defense
channels requesting Federal assistance in the acquisition of alerting monitors
and tone signaling equipment for use by local Civil Defense Fire- Rescue
personnel; and
WHEREAS, on January 4, 1964, the Village was notified orally by a
representative of the Minneapolis Hennepin County Civil Defense Office
that the subject application had been approved and that acquisition of the
subject equipment could proceed; it being further stated by the Civil Defense
representative that written confirmation of the approval would be shortly forth-
coming; and
WHEREAS, on February 24, 1964, based upon the aforementioned
notice of Federal approval and agreement regarding financial participation,
the Village Council accepted low bid for the subject equipment, said equip-
ment being subsequently purchased, and payment made therefor in the amount
of $4,073.25; and
WHEREAS, upon application being made through Civil Defense channels
for reimbursement of fifty percent (50 of the cost of acquisition, i.e. $2,036.62,
the Village was advised that such reimbursement was not possible since the
equipment had been purchased prior to Civil Defense approval of the project
application; and
WHEREAS, existing Civil Defense regulations do not provide remedy
or recourse to the Village in the event of administrative error:
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center that the Honorable Clark MacGregor, Representative
to the Congress of the United States from the Third Legislative District in
Minnesota is hereby requested and urged to introduce legislation in the Congress
to provide reimbursement to the Village of Brooklyn Center in the amount of
$2,036.62 as the Federal share of the cost of acquiring Civil Defense equipment.

The motion for the adoption of the foregoing resolution was duly seconded
by member Earl Simons and upon vote being taken thereon, the
following voted in favor thereof: Philip Cohen, Earl Simons, John Leary,
Howard Heck and Theodore Willard,
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
