by Dayton Development Co. After reviewing the Planning Commission's
recommendations on the subject application, the Mayor called for comments
from interested parties in attendance. After due consideration of the
recommendation and comments made in regard to the subject application,
member Theodore Willard introduced the following resolution and moved its
adoption:
RESOLUTION NO. 66 -222
RESOLUTION APPROVING APPLICATION 66059 SUBMITTED
BY DAYTON DEVELOPMENT COMPANY
WHEREAS, Application 66059 submitted by the Dayton Development
Co. has requested a variance to erect three (3) free standing identification
signs with program boards at locations noted on the submitted plans; and
WHEREAS, free standing identification signs are a popularly accepted
device for directing attention to a business activity; and
WHEREAS, the Village ordinances do not make provision for such
free- standing identification signs:
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center to find that the absence of ordinance provision
for free standing identification signs such as those proposed in Application
66059 constitutes a hardship, and
BE IT FURTHER RESOLVED to approve Application 66059 and grant
a variance from Section 35 -340 of the Village ordinances, provided that
the signs shall meet the following criteria:
a. They shall not exceed 16 feet above grade.
b. They shall not exceed 126 square feet in area on each of the
sign surfaces, and further provided that these signs be
identification signs rather than advertising signs in that the
signs shall not offer a specific product, advertise a specific
store or advertise any activity or service not provided on the
premises on which the sign is located.
c. The signs shall be non flashing.

Resolution No. 66 -222
The motion for the adoption of the foregoing resolution was duly seconded
by member john Leary, and upon vote being taken thereon, the following
voted in favor thereof Philip Cohen, Earl Simons, john Leary, Howard Heck
and Theodore Willard, and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
