Member Earl Simons introduced the following resolution and
moved its adoption:
RESOLUTION NO. 66 -17
RESOLUTION REGARDING APPLICATION NO. 65065 FOR REZONING
FROM R -1 TO R -3
WHEREAS the Chrysler Corporation through its Attorney, Lawrence
Brown, has made Application #65065 for rezoning of the following properties:
Tract A, Registered Land Survey No. 25, Hennepin County,
Minnesota
A portion of Lot 23, Auditor's Subdivision No. 25, Hennepin
County, Minnesota
WHEREAS, the Village Planning Commission by resolution dated
January 10, 1966 has made its recommendation;
WHEREAS, the Council has duly and fully considered the Village
Planning Commission recommendation and has conducted its own extensive
investigation of the circumstances surrounding not only Application #65065 but
also the earlier Application #65040; and
WHEREAS, the Council as a result of this investigation finds as facts,
the following:
1. The described property is located between 61st and 62nd Avenue
North in the Village of Brooklyn Center and fronts on trunk highway 152 or
"Osseo Road". The property immediately to the South is occupied by four
residential single- family dwellings and a Village Park. To the West are two
more single family dwellings and a vacant lot.
2. The applicant has indicated that it intends to use the subject property
for automobile servicing and repair and for the sale of new and used
automobiles and for related purposes including automobile body repair.
WHEREAS, the Council as a result of these facts concludes:
1. That safeguards in addition to those presently imposed by Village
ordinance must be required to protect abutting residential properties.
2. That the rezoning of this property must be subject to the requirements
of the proposed zoning ordinance when adopted.
3. That the applicant has indicated a willingness to enter into legally
binding agreements regarding said safeguards and new zoning ordinance is a
condition of the rezoning of said property.
RESOLUTION NO, 66 -11
RESOLVED, that the Village Attorney and Administrator be directed to
prepare the necessary agreements and actions preliminary to the approving
of Application #65065.

The motion for the adoption of the foregoing resolution was duly seconded
by member John Leary and upon vote being taken thereon the
following voted in favor thereof: Philip Cohen, Earl Simons, John Leary,
Howard Heck and Theodore Willard,
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
