HomeMy WebLinkAbout1966-020 CCR r Member John Leary introduced the following resolution and moved its adoption: RESOLUTION NO. 66 -20 RESOLUTION REGARDING APPLICATION NO. 65065 FOR REZONING FROM R -1 TO B -3, WHEREAS, the Chrysler Motors Corporation has made Application No. 65065 for rezoning; and WHEREAS, the Planning Commission, after a duly called public hearing, has by resolution dated January 10, 1966, made its recommenda- tions; and WHEREAS, the Council has duly and fully considered the Planning Commission recommendation and has conducted its own extensive investi- gation of the circumstances surrounding Application No. 65065; and WHEREAS, the Council as a result of this investigation makes the following findings: 1. The described property is located between 61st and 62nd Avenue North in the Village of Brooklyn Center and fronts on Trunk Highway 152 or "Osseo Road". The property immediately to the South is occupied by four residential single family dwellings and a park. To the West are two more single family dwellings and a vacant lot. To the Northwest is vacant residential property and to the North is business property. 2. The applicant has indicated that it intends to use the subject property for automobile servicing and repair and for the sale of new and used automobiles and for related purposes including automobile body repair. 3. The property is occupied by a non conforming commercial use, and is more properly a commercial rather than residential site. 4. The property is adjacent to properties to the immediate North which are occupied by retail commercial uses as are other properties in the vicinity. 5. There is a need to provide safeguards and protection for the abutting single family residential uses as to automobile traffic, noise, glare of illuminating lights, odor and proximity of commercial use. r Resolution No. 66 -20 6. Village planning is based on compatible abutting uses and employs the concept of transitional zoning creating various degrees of use and in addition requires sufficient buffering by space and trees, hedges, fences and walls for the general safety, health and welfare of its residents. 7. The property described above is of such dimensions and con- figuration as to be difficult to divide into transitional uses. 8. An acceptable buffer between the single family residential uses and the proposed commercial use would be an eight (8) foot high shadow block wall, thirty -five (35) feet from the South and West property lines with maintained landscaping. 9.. The applicant must also provide properly controlled illumination, a planned traffic pattern, protection from odors and separated car storage. RESOLVED, that the Village Council proceed in its considerations of Application No. 65065.
