and moved its adoption:
RESOLUTION NO. 66 -24
RESOLUTION DENYING APPLICATION NO. 65093
BY WILLIAM ZIESKA
WHEREAS, William Zieska has made Application No. 65093 for
rezoning of 5455 Osseo Road, Parcel 4010, Plat 89102, Hennepin
County, Minnesota, from R -1 to RB; and
WHEREAS, a legally called public hearing was held regarding
the application after which the Planning Commission.made its recommenda-
tion to the Village Council to deny rezoning; and
WHEREAS, the Village Council has held several hearings and has
made its own investigation and has become fully informed and advised
in the premises; and
WHEREAS, from said investigation the Village Council makes the
following findings
1. That the property is bounded by old Osseo Road service
road on the East Northport ort access road on the South North-
port School on the West and a residence on the North.
2. That the property is an integral part of a large area presently
zoned R -1 (single family residential).
3. That the surrounding area has in fact been put to residential
uses with the exception of a medical- dental building to the South
of the property which is a non conforming use.
4. That there has been no substantial change in the general
character or use of surrounding properties.
5. That while there is a school, playground and municipal
library in the general vicinity of the property, that such uses
are regarded as compatible with the present existing residential
uses.
6. That the comprehensive zoning plan of the village has other
areas zoned for business use which are presently unoccupied.
NOW, THEREFORE BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center that the health, safety and general welfare of
the village would best be served by maintaining the property described
in Application No. 65093 in its present zoning and that Application No.
65093 is hereby denied.

The motion for the adoption of the foregoing resolution was duly seconded
by member Theodore Willard, and upon vote being taken thereon, the
following voted in favor thereof: Philip Cohen, john Leary, Howard Heck
and Theodore Willard, and the following voted against the same: Earl
Simons, whereupon said resolution was declared duly passed and
adopted.
