HomeMy WebLinkAbout1966-033 CCR Member John Leary introduced the following resolution and moved its adoption: RESOLUTION NO. 66 -33 RESOLUTION AUTHORIZING ISSUANCE OF BUILDING PERMIT TO JOSLYN MFG. AND SUPPLY CO. SUBJECT TO AGREEMENT TO INSTALL FIRE EXTINGUISHING SYSTEM WHEREAS, Joslyn Mfg. and Supply Co. has applied for a building permit to build a building on its property at 49th and France Ave. No. which would be 86 feet by 225 feet attached to an existing building 40 feet by 80 feet at which time the combined floor area would be 21,750 square feet; WHEREAS, The Village of Brooklyn Center by Ordinance Chapter 3 -301 adopted the "Uniform Building Code 1961 Edition, published by the International Conferences of Building Officials which requires that a building of the size proposed by Joslyn Mfg. and Supply Co. con- tain a fire extinguishing system installed in accordance with Chapter 38 of said code; WHEREAS, there is presently no municipal water system servicing this area so that said requirement could be enforced and it would be un- reasonable to require the applicant to wait until water is available before enlarging its facilities; NOW, THEREFORE BE IT RESOLVED by the Village of Brooklyn Center that the Building Inspector be authorized to issue a building permit by Joslyn Mfg. and Supply Co. to build a building 86 feet by 225 feet, temporarily waiving the requirement of providing a fire extinguishing system, in consideration of its filing with the Village a legal agreement duly entered into by the corporation in which it agrees to the following: 1. join in a petition for the extension of the Municipal Water System to service its property. 2. At such time as said petition receives favorable consideration, but prior to the letting of bids,, filing a performance bond with the Village in an amount to be determined by the Village Engineer binding the company to continue the water system from its property line and install a fire extinguishing system in accordance with the Village ordinance in both the new building and also the old existing building as located on the submitted plans. 3. Hold the Village of Brooklyn Center harmless from any loss as a result of the temporary waiver of the above requirement, and to indemnify the Village of Brooklyn Center for any cost, expense or liability as the result of such waiver. Resolution No. 66 -33 (continued) BE IT FURTHER RESOLVED, that the Mayor and Clerk be authorized to enter into said agreement with Joslyn Mfg. and Supply Co. February 21, 1966 Date Mayor ATTEST: Clerk The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, Earl Simons, John Leary, Howard Heck and Theodore Willard, and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted.
