and moved its adoption:
RESOLUTION NO.66 -86
RESOLUTION ORDERING A CERTAIN BUILDING LOCATED AT
5536 BRYANT AVENUE NORTH, BROOKLYN CENTER, MINNESOTA
TO BE RAZED AND REMOVED
WHEREAS, E. P. Sjoberg is the owner of a certain building located
at 5536 Bryant Avenue North, Hennepin County, Brooklyn Center, Minnesota;
and
WHEREAS, this building is best described as an abandoned basement
structure with a wooden capping, decking or roof; and
WHEREAS, after receipt of numerous complaints, jean Murphey, the
Building Inspector of the Village of Brooklyn Center, on the 7 th day of
April, 1966, inspected the property and submitted his report to the Council,
which described the premises as generally abandoned in a dilapidated and
extreme state of disrepair; stating that it is of generally unsightly appearance,
that it violates the Building Code of the Village of Brooklyn Center in that
a building permit was issued June 1, 1948 for a full one -story dwelling which
has never been completed except for the construction of basement walls
which have deteriorated and are inadequate, and capping or flooring and.
floor supports, which have deteriorated and which have developed holes
and cracks through which a person could fall; and
WHEREAS, the Council of the Village of Brooklyn Center finds that
the above described building is inadequately maintained, dilapidated and
in a state of extreme disrepair; is in an unsanitary condition; constitutes
a hazard to public safety, a menace to public health and a fire hazard,
violates the Building Code;
NOW, THEREFORE, BE IT RESOLVED that E. P. Sjoberg shall be
ordered to raze and remove the cement and wooden structure located at
5536 Bryant Avenue North, Brooklyn Center, Minnesota, on the property
legally described as:
The North 75 feet of the South 150 feet lying West of the
East 150 feet of Lot 41, Garcelons Addition, Hennepin
County, Minnesota,
And that this action is being taken pursuant to Minnesota Statutes
Annotated ss. 463. 15 463.26 on the grounds that said building is a
hazardous building within the meaning of that statute;

BE IT FURTHER RESOLVED that E. P. Sjoberg, his heirs or
assigns, must comply with this order within twenty (20) days from the
date of service upon him or within twenty (20) days file an answer thereto,
otherwise a motion for summary enforcement of this order will be taken by
the Village of Brooklyn Center in the Hennepin County District Court.

The motion for the adoption of the foregoing resolution was duly seconded
by member Howard Heck, and upon vote being taken thereon the
following voted in favor thereof: Philip Cohen, Earl Simons, john Leary,
Howard Heck and Theodore Willard,
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
