and moved its adoption:
RESOLUTION NO. 66 -103
RESOLUTION ACCEPTING OFFER OF DAYTON DEVELOPMENT
COMPANY FOR PURCHASE OF VILLAGE OWNED PROPERTY
LOCATED AT SOUTHEAST IN'T'ERSECTION OF COUNTY ROAD 10
AND SHINGLE CREEK
WHEREAS, The Village of Brooklyn Center is the owner of certain
real property located at the southeast intersection of County Road 10
and Shingle Creek legally described as:
That part of the Southeast Quarter of the Northwest Quarter,
Section 2, Township 118, North, Range 21 West described
as follows: Commencing at the Southwest corner of said
Southeast Quarter of said Northwest Quarter; thence East along
the South line of said Southeast Quarter of said Northwest
Quarter a distance of 205 feet to the West line of Tract B,
Registered Land Survey No. 1161; thence North along said
West line of said Tract B, 160.29 feet to the South right of
way of County Road No. 10 as was established by Doc. No.
3357219, records of the Register of Deeds of Hennepin
County; thence West 205 feet along said right of way to the
West line of said Southeast Quarter of said Northwest Quarter;
thence South to the point of beginning. and
WHEREAS, the Village Council after due deliberation has determined
that it can foresee no Village use for said property in the future and that
it would be in the best interests of the Village to sell said real property
if a reasonable sale can be negotiated; and

WHEREAS, the Village Council ordered appraisals to be made of
said real property which were received; and
WHEREAS, the Dayton Development Company has offered to purchase
said real estate for a price of twenty thousand dollars ($20, 000.00) as con
tained in an executed Purchase Agreement which has been received together
with a check in the sum of two thousand dollars ($2,000.00) as earnest money;
and
WHEREAS, said offer is supported by the independent appraisals as
being fair and reasonable, and the Village Attorney has reviewed said
Purchase Agreement and finds it to be in proper form and order:
NOW THEREFORE BE T RESOLVED that The Village Council accept

the offer of Dayton Development Company for the purchase of said above
described real estate for the sum of twenty thousand dollars ($20, 000.00),
the buyer to pay real estate taxes due in the year 1967 and any unpaid
installments of special assessments payable therewith and thereafter, and

that the Mayor and Clerk be authorized to execute all documents required
to complete the sale.

The motion for the adoption of the foregoing resolution was duly seconded
by member Theodore Willard and upon vote being taken thereon,
the following voted in favor thereof: Philip Cohen, Earl Simons, john
Leary, Howard Heck and Theodore Willard,
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
