moved its adoption:
RESOLUTION NO. 65 -127
RESOLUTION REGARDING APPLICATION NO. 65040
FOR REZONING FROM R -1 TO B -3
WHEREAS, Chrysler Corporation through its attorney Lawrence Brown
has made Application 65040 for rezoning of the following properties:
Tract A, Registered Land Survey No. 910,
Hennepin County, Minnesota.
A portion of Lot 23, Auditor's Subdivision No. 25,
Hennepin County, Minnesota.
WHEREAS, the Village Planning Commission by resolution dated
June 7, 1965, has recommended denial of this application; and
WHEREAS, the Council, pursuant to Resolution No. 65 -98 dated
June 21, 1965, has conducted its own extensive investigation of the circum-
stances surrounding Application 65040; and
WHEREAS, the Council, as a result of this investigation concludes:
1. The establishment of a B -3 district at the point proposed in the
application would permit uses, including the proposed automobile
dealership and its related uses, which would cause a substantial
conflict with the single family residences which have grown up
around the site on the South, West, and Northwest.
The relatively high degree of personal and automotive activity
generally seen in connection with B -3 uses creates noise, exhaust
fumes and odors, light glare, and accumulations of debris and
waste produced by the type of use. The manifestations of commercial
activity detract from the peace and quiet and even the value of the exist-
ing ,residential community.
The scale and size of commercial buildings and the scale and size of
the proposed building, together with the storage of large numbers of
automobiles, would tend to decrease the open space and light and
air enjoyed by the surrounding single family development.
2. The establishment of a B -3 zone at the proposed site would cause
congestion on Osseo Road and reduce the safety of travel on Osseo
Road.

3. The establishment of a B -3 zone at this point would be contrary
to the "Osseo Road Development Goals" adopted by the Council
in principle, wherein the Council recognizes the need to preserve
the Osseo Road as an arterial roadway and to preserve, so far as
reasonably possible, the value, peace and quiet of the existing
residential development.
4. The establishment of a retail commercial zone at this point along
Osseo Road would be inconsistent with the Council's policy and
adopted planning principle of discouraging strip commercial devel-
opment along the roadway.
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, upon the recommendation of the Planning
Commission, and upon all of the proceedings conducted with respect to
this application, TO DENY APPLICATION NO. 65040 FOR REZONING TO B -3.

The motion for the adoption of the foregoing resolution was duly seconded
by member Phil Cohen and upon vote being taken thereon, the follow-
ing voted in favor thereof: Gordon Erickson, Phil Cohen, John Leary, and
Howard Heck,
and the following voted against the same: Earl Simons;
whereupon said resolution was declared duly passed and adopted.
