and moved its adoption:
RESOLUTION NO. 65 -146
RESOLUTION ESTABLISHING TERMS FOR CONVEYANCE OF DALLAS
ROAD STREET RIGHT OF WAY FROM MINNEAPOLIS GAS COMPANY
TO VILLAGE OF BROOKLYN CENTER
WHEREAS, the Village of Brooklyn Center Council has determined
that Dallas Road should extend southward from 70th Avenue North to
property owned by the Minneapolis Gas Company and thence easterly
across said property to Willow Lane,
WHEREAS, the Village Engineer and the Minneapolis Gas Company
have tentatively agreed to the feasibility of extending Dallas Road
across said Minneapolis Gas Company property described as follows:
All that part of the south 75 feet of Lot 20, Auditor's
Subdivision No. 309 described as follows: Beginning at a
point on the South line of said Lot 20, four hundred seven
(407) feet east of the Southwest corner thereof, thence
west along the South line of Lot 20 to a point two hundred
(200) feet east of the Southwest corner of said Lot, thence
Northerly along a line parallel to the Westerly line of
said Lot to the North line of the said South seventy five
(75) feet of Lot 20, thence east along said North line to
a point four hundred seventeen (417) feet East of the
intersection of said North line with the Westerly line of
said Lot, thence Southerly to point of beginning, except
the Easterly twenty five (25) feet of the above described
tract.
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota, as follows:
If the Minneapolis Gas Company conveys to the Village of Brooklyn
Center a warranty deed for Dallas Road street right -of -way purposes
across the above described property, said deed being subject to an
easement to construct, operate, inspect, maintain, repair, alter, or
move gas mains, service pipes, gas pipe lines and appurtenances, the
Village of Brooklyn Center Council agrees that no assessments shall
be levied against the remainder of the property owned by the Minneapolis
Gas Company on Lot 20, Auditor's Subdivision No. 309, for sanitary
sewer, water main, or street improvements constructed in Dallas Road.

The motion for the adoption of the foregoing resolution was duly seconded
by member john Leary, and upon vote being taken thereon, the following voted in
favor thereof: Gordon Erickson, Phil Cohen, john Leary, Earl Simons, and
Howard Heck, and the following voted against the same: none; whereupon said
resolution was declared duly passed and adopted.
