moved its adoption:
RESOLUTION NO. 65 152
RESOLUTION CORRECTING SANITARY LATERAL ASSESSMENT
59 AB ON THE NORTH 188.75 FEET OF WEST 158.4 FEET
OF EAST 314.4 FEET EXCEPT ROAD OF LOT 57 AUDITOR'S
SUBDIVISION NO. 218 (PLAT 89103, PARCEL 7905)
WHEREAS, the above listed property was assessed for 2 units
of Sanitary Lateral, Project 1959 -33 on Knox Avenue North, and
WHEREAS it has been determined that the location of the
house at 5850 Knox Avenue North restricts the property to one
building site
NOW, THEREFORE BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center to authorize correction of Levy 2415,
San Lateral 59 AB from $612.32 to $306.16 on the above listed
property and that the overpayment of the 1961 through 1965/66
installments to the County Treasurer, be refunded to the fee
owner of record.
BE IT FURTHER RESOLVED, that the County Auditor is authorized
and directed to accept the levy correction and the Village of
Brooklyn Center shall make a refund in the amount of $164.62
to A. A. Wendell, 5850 Knox Avenue North, fee owner of record during
assessment period.

The motion for the adoption of the foregoing resolution was duly
seconded by member John Leary and upon vote being taken
thereon, the following voted in favor thereof: Gordon Erickson,
Phil Cohen, John Leary, Earl Simons and Howard Heck,
and the following voted against the same: None;
whereupon said resolution was declared duly passed and adopted.
