moved its adoption:
RESOLUTION NO. 65 -187
RESOLUTION APPROVING APPLICATION NO. 65029
WHEREAS, Edward H. Scharmer has made Zoning Application No. 65029
for certain variances from the Village Zoning Ordinance; and
WHEREAS, the application requests variances:
(a) From Section 35 -401 35 -402 regarding side yard set backs;
(b) From Section 35 -420 and 35 -701 regarding off street parking;
(c) From Section 35 -702 regarding driveways for off street parking;
(d) From Section 35 -620 regarding a required loading berth;
and
WHEREAS, the Council finds:
(a) The applicant's property is zoned to permit industrial uses and
the applicant's building was constructed many years before the enact-
ment of the present Village Zoning Ordinance;
(b) The variances are requested to permit the construction cf a 30'x32'
addition to the applicant's existing building, which addition is to be
used solely for warehousing, storage and shipping and is not to be
used for manufacturing;
(c) While truck drivers must now park the truck cab upon the public
street in order to load or unload at the applicant's building, this
addition will permit them to park entirely off of the public street.
(d) The size and shape of this lot and location of the building are
unique and a strict application of the ordinances above mentioned
would unreasonably limit the applicant's use for the purposes permitted
in the zoning district;
(e) The residents of the area have not objected to the proposed addition
and related variances and the variances will not be detrimental to the
public welfare or injurious to other land or improvements in the
neighborhood;
(f) The proposed variances will not impair an adequate supply of light
and air to adjacent property, or substantially increase the congestion
of the public streets, or increase the danger of fire, or endanger the
public safety, or substantially diminish or impair property values
within the neighborhood,
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota that:
RESOLUTION NO. 65 -187
The following variances from the requirements of Chapter 35 of the
Village Ordinances shall be granted with respect to the property at 4865 Osseo
Road known as Part of Lot 1, Block 4, Brooklyn Manor Addition:
1. From Section 35 -401 and 35 -402 regarding side yard set backs;
2. From Section 35 -420 and 35 -701 regarding off street parking;
3. From Section 35 -702 regarding driveways for off street parking;
4. From Section 35 -620 regarding a required loading berth.

The motion for the adoption of the foregoing resolution was duly seconded
by member Phil Cohen and upon vote being taken thereon,
the following voted in favor thereof: Gordon Erickson, Phil Cohen, john Leary,
Earl Simons and Howard Heck,
and the following voted against the same: None
whereupon said resolution was declared duly passed and adopted.
