HomeMy WebLinkAbout1965-188 CCR Mem ber Phil Cohen introduced the following resolution and moved its adoption: RESOLUTION NO. 65 -188 RESOLUTION CALLING FOR THE RE- CONSIDERATION OF APPLICATION NO. 65001 WHEREAS, W. O. Patterson has made application number 65001 for the rezoning of a portion of Lot 18, Auditor's Subdivision No. 25 to B -2, and WHEREAS, following the Village's denial of the said application, litigation ensued with respect to the Village's denial which has now terminated adversely to the Village, and WHEREAS, the issues between the Village and the applicant having been resolved, and the Village having determined not to perfect an appeal, the Village desires to reconsider the said application and related proceedings, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center: 1. On September 27, 1965 at its regular meeting, the Council will act upon Application No. 65001 of W. O. Patterson for the rezoning of a portion of Lot 18, Auditor's Subdivision No. 25 to B -2, which may more specifically be described as Lot 2, Block 1 of the PROPOSED P.B.C. First Addition (a map of said proposed P. B.C. First Addition being in the files of the Brooklyn Center Building Inspector). 2. Subject to appropriate application by W. O. Patterson, the Council hereby directs the Planning Commission to hold a public hearing to con- sider and review the Preliminary Plat for P. B.C. First Addition on October 7, 1965. 3. The Council further directs the Planning Commission to consider and review the site plans for a restaurant to be located on Lot 2, Block 1 of the PROPOSED P. B.C. First Addition on October 7, 1965. 4. On October 11, 1965: (a) The Council will consider the preliminary plat of the P. B.C. First Addition and the Planning Commission's Report thereon; (b) The Council will review and act upon the Planning Commission's report pertaining to the drawings, plans, layouts, agreements, bonds and other materials submitted by the applicant pursuant to section 35 -707 of the Ordinances of the Village of Brooklyn Center. (c) The Council will consider the applicant's building plans and specifications and the building inspector's recommendations and shall determine whether all of the applicable ordinances and statutes will be complied with. RESOLUTION NO, 65 -188 5. The Council will act upon the final plat of the P. B.C. First Addition at its first regular meeting following the filing of the Final Plat with the Village Clerk. If all requirements are met, the Council will direct the Building Inspector to issue a building permit to the applicait upon the payment of the proper fee.
