RESOLUTION NO. 65 -218
RESOLUTION APPROVING PLANNING COMMISSION
APPLICATION NO. 65080 SUBMITTED BY NAEGELE
ADVERTISING AND LEON CHELMO
WHEREAS, Naegele Advertising and Leon Chelmo have submitted
Application No. 65080 requesting a variance to permit the construction of
a free standing rotating sign for Mr. Suds car wash on Parcel 5910, Auditor's
Subdivision 216, and
WHEREAS, the council has reviewed the provisions of the present
ordinances and the proposed sign ordinance which has been prepared as a
part of the effectuation devices under the "701" planning study, and
WHEREAS, the council finds that the proposed sign ordinance does
not prohibit all rotating signs, and
WHEREAS, the council finds that rotating signs may be permitted when
designed to limit distraction to motorists and occupants of abutting property,
and
WHEREAS, the council has determined that the undesirable features of
rotating signs are a function of speed of rotation, height above the ground,
size and lighting,
NOW, THEREFORE BE IT RESOLVED that the Council of Brooklyn Center,
Minnesota approves Application No. 65080 under the following conditions:
1. The total height of the sign shall be no more than 24 feet
above curb grade.
2. The sign shall be located in a line with the gasoline pump
islands as shown on the plans and 15 feet from the property
line.
3. The sign shall rotate at a rate to be determined by the Council,
within two weeks.
4. The rotating portion of the sign shall be not less than 12 feet
above curb grade.
5. The area of a single surface of the rotating portion of the sign
shall not exceed 150 sq. ft. and the total area of one side shall
not exceed 180 sq. ft.
6. The sign shall have an interior light source only, which shall
be of a constant intensity and color and shall not have
reflective surfaces designed to reflect light from outside sources.
7. The rotating sign is approved on the condition that a second free
standing sign will not be erected.

The motion for the adoption of the foregoing resolution was duly seconded
by member Howard Heck and upon vote being taken thereon, the following
voted in favor thereof: Gordon Erickson, Phil Cohen, john Leary, Earl Simons
and Howard Heck, and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
