RESOLUTION NO. 65 -9
RESOLUTION AMENDING AGREEMENT BETWEEN THE VILLAGE
OF BROOKLYN CENTER, MINNESOTA, AND THE VILLAGE OF
BROOKLYN PARK, MINNESOTA, RELATIVE TO THE INTER
CONNECTION OF SEWERS
WHEREAS, the Village of Brooklyn Center, Minnesota, and the
Village of Brooklyn Park, Minnesota, entered into an agreement
entitled "Agreement Between the Village of Brooklyn Center,
Minnesota, and the Village of Brooklyn Park, Minnesota, Relative
to the Interconnection of Sewers effective October 19, 1961, and
WHEREAS, it appears equitable to Brooklyn Center and Brooklyn
Park that Sub- section VII of said agreement be amended,
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota, that Sub section VII of the
agreement entitled "Agreement Between the Village of Brooklyn
Center, Minnesota, and the Village of Brooklyn Park, Minnesota,
Relative to the Interconnection of Sewers" be amended to read as
follows:
"For the privilege of discharging its sewage into the Brooklyn
Center system, Brooklyn Park shall pay to Brooklyn Center a sewer
rental charge per 1,000 gallons of sewage discharged into the
Brooklyn Center sewer system, which charge shall be composed of
the following costs:
(1) The current prevailing cost of disposing of sewage into
the Minneapolis sewer system. This cost shall be computed by dividing
the current Minneapolis charges to Brooklyn Center by the corresponding
period metered and direct sewage flow into the Minneapolis sewer
system from Brooklyn Park and Brooklyn Center combined.
(2) The cost of maintenance and operation of lift stations
within the Brooklyn Center system. This cost shall be computed by
dividing the previous calendar year pumping costs (as determined by
audit report) by the corresponding period total sewage flow discharged
from Brooklyn Park and Brooklyn Center combined.
(3) The cost of maintaining joint use sewer lines within
Brooklyn Center. This cost shall be computed by multiplying the
previous calendar year transmission costs (as determined by audit

product shall be divided by the corresponding period total sewage
flow .discharged from Brooklyn Park and Brooklyn Center combined.
(4) The cost of administering the Brooklyn Center sewer system.

(5) The cost of depreciation of the joint use sewer facilities
within the Brooklyn Center sewer system. This cost shall be computed
by dividing the annual one per cent, straight line depreciation cost
of joint use facilities by the corresponding period sewage flow
discharged from Brooklyn Park and Brooklyn Center combined.
In addition, Brooklyn Park shall pay to Brooklyn Center a
flat rate of $125.00 per quarter for accounting and record keeping
pertaining to the sewer interconnection
Said amendment to Sub section VII of the agreement shall be
considered effective as of July 1, 1964.
BE IT FURTHER RESOLVED that said amendment be conditioned
upon passage of this resolution by the Village Council of Brooklyn
Center and the Village Council of Brooklyn Park.
Certified copies of said resolution, as and when adopted,
shall be filed with the Village Clerk of Brooklyn Center and the
Village Clerk of Brooklyn Park immediately after such adoption."

The motion for the adoption of the foregoing resolution was duly
seconded by member Joha Lea ry and upon vote being taken
thereon the following voted in favor thereof: Gordon Erickson, Howard
Heck, Phil Cohen, john Leary and Earl Simons
and the following voted against the same: None;.
whereupon said resolution was declared duly passed and adopted.
