RESOLUTION NO. 65 -23
RESOLUTION OPPOSING THE ADOPTION OF HOUSE FILE NUMBER
212 AND REJECTING THE GENERAL CONCEPT OF COMPULSORY
ARBITRATION FOR THE RESOLUTION OF PUBLIC EMPLOYEES DISPUTES
WHEREAS, there has been introduced into the House of Representatives
of the State of Minnesota a bill for an act, designated House File #212, which
would impose upon the political subdivisions of the State compulsory arbitration
of disputes with their respective employees; and
WHEREAS, the democratic form of government places control over public
policy, taxation and expenditures in the hands of representatives freely elected
by the citizens residing within the jurisdiction of the several governmental
units; and
WHEREAS, the concept of compulsory arbitration violates this control by
removing from the jurisdiction of the elected representative the authority to
determine policy regarding public employees, and places such authority in the
hands of persons not responsible to the citizens of the governmental unit; and
WHEREAS, in those instances where the result of compulsory arbitration
would involve the expenditure of public funds, the raising of such funds would
constitute taxation without representation and would be contrary to the American
concept of justice and representative government:
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village
of Brooklyn Center as follows:
1. The bill for an act designated House File #212 is actively opposed,
both in its present form and fundamental concept, and all representatives of
the people of the State of Minnesota are called upon to work against the passage
of the bill.
2. Copies of this resolution shall be certified to the Governor of the
State of Minnesota, the Chairman of the House Committee on Labor Management
Relations, and the representatives of the Thirtieth Legislative District.

The motion for the adoption of the foregoing resolution was duly seconded by
member Howard Heck and upon vote being taken thereon the following
voted in favor thereof: Gordon Erickson, Howard Heck, John Leary, Phil
Cohen and Earl Simons
and the following voted against the same: None;
whereupon said resolution was declared duly passed and adopted.
