its adoption:
RESOLUTION NO. 65 -82
RESOLUTION DENYING VARIANCE APPLICATION NUMBER 65024
WHEREAS, Martin Raskin proposes to construct two 18 unit apartment
buildings upon Lot 1, Block 1, Greenlawn Addition, Hennepin County,
Minnesota; and
WHEREAS, the said property has an area of approximately 62820
square feet; and
WHEREAS, Section 35 -401 of the Village of Brooklyn Center Ordinances
requires a minimum lot area of 2700 square feet per unit for multiple dwellings
in a B -3 zone; and
WHEREAS, the applicant has requested a variance to permit him to
erect 36 multiple dwelling units with only 1744 square feet per unit or a
variance of 35 from the Ordinance; and
WHEREAS, the applicants purpose in making_ this request appears
primarily to be that of increasing the value or income potential of the parcel
of land, and
WHEREAS, the Council believes that the density requirement mentioned
above is reasonable and well calculated to permit reasonable construction of
multiple dwellings on the one hand without, on the other hand, unreasonably
increasing local traffic or interferring with the use and enjoyment of neighboring
residential property;
NOW, THEREFORE BE IT RESOLVED, by the Village Council of the Village
of Brooklyn Center that application No. 65024 for a 35 variance from the
provision of Section 35 -401 of the Village Ordinanc e an reby denied.

The motion for the adoption of the foregoing resolution was duly seconded by
member Earl Simons and upon vote being taken thereon the following
voted in favor thereof: Gordon Erickson, Phil Cohen, john Leary, Earl Simons
and Howard Heck
and the following voted against the same: None;
whereupon said resolution was declared duly passed and adopted.
