HomeMy WebLinkAbout1965-083 CCR Member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION NO. 65 -83 RESOLUTION DENYING APPLICATION NO. 65030 FOR REZONING WHEREAS, Darrel Farr has applied for a rezoning of Lot 1, Block 2 and Lot 1 Block 1 of Proposed Plat of Farr's First Addition to the Village of Brooklyn Center; and WHEREAS, the Council has held a public meeting on May 17, 1965 pursuant to notice as required by ordinance and has heard the applicant, Darrel Farr, his agent, Mr. Carlson, and Mr. Farr, Senior, and Mr. Ralph Luchsinger speaking in favor of the application, and has also heard several residents of the area, including Mr. Mankowski, Mrs. Westbury, Mrs. George Gerber, Mr. Lustig and Mr. Higginbotham in opposition to the application, and has also heard comments from Mr. Roger Scherer, a member of the 701 Planning Study local committee, the Chief of Police, and the Village EnginVer, and the Council having also considered its personal knowledge of the facts and circumstances surrounding this application; and WHEREAS, the Council makes the following findings of fact: 1. Lot 1, Block 1, Farr's Proposed First Addition is located West of Willow Lane and is bounded on the West by a motel and on the South by the Lynn River Apartments and on the North by open property, part of which has been approved for multiple dwelling development. 2. Lot 1, Block 2, Farr's Proposed First Addition is located across Willow Lane to the East of Lot 1, Block 1 and fronts directly upon the scenic Miss- issippi River. Lot 1, Block 2 of the proposed addition is bordered on the South and North by residential dwellings and vacant property and to the West by Willow Lane and Lot 1, Block 1 of the proposed addition. 3. The applicant proposes to construct and maintain multiple dwellings on Lot 1, Block 1, and Lot 1, Block 2 as a cohesive unit and the lessees of apartments on Lot 1, Block 1 will be given access to the Mississippi River across and upon Lot 1, Block 2. RESOLUTION NO. 65 -83 4. During the last winter, 1964 -1965, residents of the Lynn River apartment buildings would, during periods of heavy snow accumulation park upon Willow Lane, narrowing the travelling portion of the road to one lane or less and making it impossible to drive municipal fire equipment or road equipment on Willow Lane. 5. The 701 Planning Study for this area has not been com- pleted but it appears that the present thinking of the local committee and Planning Consultant does not favor multiple dwelling use for Lot 1, Block 2 of the proposed addition. 6. The applicant has not contended nor brought forward any facts or opinions suggesting that Lot 1, Block 2 has unusual conditions which would make residential de- velopment unreasonable. Mention has been made that the lot is lower than some of the neighboring property, though this has been caused by the removal of dirt from the lot. 7. The applicant has not contended that Lot 1, Block 2 would have no marketable value for single family dwelling purposes. 8. The proposed apartment on Lot 1, Block 2 would be of a much larger scale and size than the neighboring residen- tial dwellings. 9. The residents of the neighboring single family dwelling have stated at the public meeting that they purchased or constructed their dwellings relying upon the residential zoning of the lots abutting the Mississippi River. Mrs. George Gerber stated that this was true of her when her family purchased property immediately to the South of Lot 1, Block 2 fifteen years ago, and also that she hoped to remain in the area for many years to come. 10. The Council in 1963 turned down a similar application by Mr. Farr, though notwithstanding that action, the Council has received all of the facts and circumstances surrounding the present application; and WHEREAS, the Council reaches the following conclusions: RESOLUTION NO. 65 -83 Lot 1, Block 2 Proposed Farr's Addition 1. A multiple dwelling upon Lot 1, Block 2, abutting the river, would break the continuity of residential develop- ment of the lots to the North and to the South, in that it would place a more intensive land use and a large out of scale building in a line of heretofore residential single family development. 2. The neighboring residents have invested years of time and a substantial measure of their resources developing the residential lots abutting the river and it would be unfair to them to permit the use described in the next preceding paragraph. 3. The essential character of the lots abutting the river is residential single family. 4. The Council also recognizes that apartment dwellings generate more automobile traffic on a given lot and that the experience of last winter shows that the greater number of cars on a given area of land aggravates traffic and parking conditions. 5. Access of both lots to the river landing of Lot 1, Block 2 would multiply the activity on that lot many times, and thus aggravate the conflict between this lot and the neighboring single family lots. Lot 1, Block 1 Proposed Farr's Addition 1. A multiple dwelling upon Lot 1, Block 1 would be con sistent with the development of the property to the North, West and South and with the Village planning. NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota that the application of Darrel Farr, No. 65030, for rezoning o=ayor 1 and Lot 1, Block 2, Farr's Proposed First A May 24, 1965 Date ATTEST: 1� �l Clerk RESOLUTION NO. 65 -83 The motion for the adoption of the foregoing resolution was duly seconded by member John Leary and upon vote being taken thereon the following voted in favor thereof: Gordon Erickson, Phil Cohen, John Leary, Earl Simons and Howard Heck, and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted.
