on the abatement of a nuisance condition at 5329 James Avenue North.
The Clerk produced an affidavit of publication of notice of hearing on
the proposed abatement showing two weeks publication thereof in the official
newspaper, the last publication being on May 26, 1965, which affidavit was
examined and found satisfactory and was ordered placed on file.
The Mayor then called upon all property owners in attendance to present
arguments either for or against the proposed abatement. After hearing and con
sidering all objections, and all property owners appearing in favor of the proposed
abatement, member Phil Cohen introduced the following resolution and moved its
adoption:
RESOLUTION NO. 65 -96
RESOLUTION DETERMINING THE EXISTENCE OF A NUISANCE
CONDITION AT 5329 JAMES AVENUE NORTH AND PROVIDING FOR
ITS ABATEMENT BY APPROVAL OF IMPROVEMENT PROTECT 1965 -38
WHEREAS, the Village Council has received numerous complaints regard-
ing the house located at 5329 James Avenue North; and
WHEREAS, the premises are presently abandoned and in a state of dis-
repair; and
WHEREAS, the broken windows and unlocked doors of the house allow
children to use the premises as a play area; and
WHEREAS, the owner of the subject house has made an inadequate and
unsatisfactory effort to limit ingress and egress from the premises by boarding
up some of the exterior openings; and
WHEREAS, the Council believes that the premises are injurious to the
health, morals, welfare and safety of the community; and
WHEREAS, the Building Inspector has made a preliminary report advising
that the boarding up of the house could be accomplished at a cost of $100.00:
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village
of Brooklyn Center as follows:
1. The dwelling located at 5329 James Avenue North is hereby
determined to be a public nuisance.
2. The owner of the above described property shall be notified of
the Council's findings and shall be allowed a period of ten days
from the date of notice to abate the nuisance condition fully.

3. If, ten days after notice has been given to the owner of the
subject property, the nuisance condition has not been fully
abated, the Building Inspector shall board up all exterior doors
and windows of the subject dwelling, the estimated cost for
said boarding up to be approximately $100.00.
4. Improvements made to the dwelling located at 5329 James Avenue
North pursuant to this resolution shall comprise Improvement
Project 1965 -38.
5. The costs for Improvement Project 1965 -38 shall be assessed
against the property, legally described as Lot 6, Block 3,
Humbolt Addition, Hennepin County, Minnesota, and certified
to the County Auditor to be spread upon the tax rolls as a
special assessment to be paid in full within one year following
such certification.

The motion for the adoption of the foregoing resolution was duly seconded by
member Howard Heck, and upon vote being taken thereon, the following voted
in favor thereof: Gordon Erickson, Phil Cohen, Earl Simons and Howard Heck,
and the following voted against the same: None; whereupon said resolution
was declared duly passed and adopted.
